A (IN)POSSIBILIDADE DE MINERAÇÃO EM UNIDADES DE
CONSERVAÇÃO DE PROTEÇÃO INTEGRAL A PARTIR DA ANÁLISE DOS
PLANOS DE MANEJO

RESUMO
A mineração é uma das atividades econômicas brasileiras que mais tem
crescido nos últimos anos, apesar de os impactos ambientais dela decorrentes
serem danosos, pois os bens extraídos não são renováveis e nem sempre há
cuidados efetivos quando da exploração da região. Para que esta ocorra são
necessários estudos e autorizações governamentais. Contudo, surge a dúvida
sobre a possibilidade ou não de mineração em áreas protegidas legalmente,
pois estas, em alguns casos possuem restrições específicas ou lacunas sobre
o assunto. A Lei do Sistema Nacional de Unidades de Conservação (Lei 9.985,
de 18 de julho de 2000) é a atual normativa que regula as Unidades de
Conservação (UCs) no Brasil. A referida lei prevê que as UCs estão divididas
em duas categorias: UCs de Proteção Integral e UCs de Uso Sustentável. Há
UCs em que é perceptível a proibição, sendo que em ambas o Plano de
Manejo e de Zoneamento é um dos principais documentos utilizados para
regular
as
atividades
a
serem
desenvolvidas
em
cada
localidade.
Existe grande questionamento, inclusive pautado na legislação, sobre a
exploração das UCs de Proteção Integral, independentemente das atividades
propostas. Assim, o presente trabalho visa realizar a verificação dos Planos de
Manejo (quando existentes) destas unidades, por amostragem, com o intuito de
constatar como a mineração é tratada e se há previsão da sua ocorrência em
tais documentos. Estão sendo utilizados dados bibliográficos e documentos
disponibilizados nos sites oficiais: Ministério do Meio Ambiente (Cadastro
Nacional de Unidades de Conservação – CNUC) e Instituto Chico Mendes de
Proteção da Biodiversidade (ICMBio). Até 24/09/2015 haviam sido analisados
Planos de Manejo de aproximadamente 20 UCs na Região Norte, Centro Oeste
e
Nordeste,
sendo
implementação
percebida
da
UC,
mas
a
presença
de
mineração
havendo
proibição
a
antes
da

então. Preliminarmente foi observada a existência de Plano de Manejo, mas os
documentos não são claros quanto a exploração da lavra mineral, vedando
expressamente em alguns casos. Algumas regiões inclusive se tornaram UCs
para evitar a mineração.

THE (IN) POSSIBILITY OF MINING ON INTEGRAL PROTECTION
CONSERVATION UNITS BASED ON THE ANALYSIS OF MANAGEMENT
PLANS

ABSTRACT
Mining is one of Brazil s economic activities that has grown the most in recent
years, despite the environmental impacts arising from it are bad because the
goods taken are not renewable and there are not always effective care when
operating in the region. For this to occur are necessary studies and
governmental permits. However, the question arises about whether or not
mining in protected areas legally, because these in some cases have specific
restrictions or gaps on the subject. The Law of the National Protected Areas
System (Law 9985 of July 18, 2000) is the current regulations governing the
Conservation Units (UCs) in Brazil. The law provides that the UCs are divided
into two categories: UCs Integral Protection and Sustainable Use UCs. There
UCs it is noticeable the ban, and in both the Management Plan and Zoning is
one of the main documents used to regulate the activities to be developed at
each location. There is a great question, including guided by the legislation on
the exploitation of UCs full protection, regardless of the proposed activities. The
present study aims at verifying the management plans (if any) of these units by
sampling, in order to see how mining is treated and if there is forecast of their
occurrence in such documents. Are being used bibliographic data from the
documents made available on the official websites: Ministry of the Environment
(National Register of Protected Areas - CNUC) and the Chico Mendes Institute
for Biodiversity Protection (ICMBio). To 09.24.2015 were analyzed Plans
approximately 20 UCs management in the North, Midwest and Northeast, and
perceived the presence of mining before the implementation of UC, but there is
prohibition thereafter. Preliminarily it observed the existence of management
plan, but the documents are not clear about the exploitation of mineral mining,
expressly forbidding in some cases. Some areas even have become UCs to
prevent mining.
