CONDITIONS
1. Proibição do trabalho escravo

O Fornecedor não irá tolerar, não participará nem benefício
de nenhum tipo de trabalho escravo, incluindo o trabalho
em regime de servidão, a servidão por dívidas, o trabalho
escravo em instituições penitenciárias, a escravidão ou
tráfico de seres humanos. Todo emprego é voluntário, e as
pessoas trabalhadoras são livres para deixar o trabalho a
qualquer momento ou finalizar sua contratação.
The Supplier will not tolerate, will not participate nor
benefit of any form of forced labor, including bonded labor,
debt bondage, forced prison labor, slavery or human
trafficking. All employment is voluntary, and all workers are
free to leave the job at any time or terminate their contracts.

O Fornecedor não irá tolerar, não praticar nem apoiar a
utilização de trabalho infantil. O termo “infantil” faz
referência a qualquer pessoa menor de 15 anos (ou 14 anos
se assim permite a legislação), que não tenha idade
necessária para completar a educação obrigatória ou não
tenha a idade mínima para trabalhar no país, mesmo que
tenha mais do que essas idades.
The Supplier will not tolerate, will not practice nor support
the use of child labor. The term "child" refers to anyone
under 15 (or 14 if permitted by national law), or that is not
the age for completing compulsory education, or do not have
the minimum age to work in the country, the greater of
them.
3. Não a Discriminação

O Fornecedor não irá tolerar, não praticar nem apoiar
nenhum tipo de discriminação baseada em raça, cor, idade,
sexo, orientação sexual, etnia, falta de capacidade, gravidez,
religião, ativismo político, afiliação sindical ou estado civil
nos contratos, remunerações e em práticas relacionadas com
o emprego, como promoções, bonificações, acesso a
formação, demissão ou aposentadoria.
The Supplier will not tolerate, will not practice nor support
any kind of discrimination based on race, color, age, sex,
sexual orientation, ethnicity, disability, pregnancy, religion,
political affiliation, union membership or marital status in
contracts, living wages and labor practices related to
employment practices such as promotions, bonuses, access
to training, dismissal or retirement.

collective bargaining
O Fornecedor vai respeitar os direitos das pessoas
trabalhadoras de associar-se livremente, unir-se ou não a
sindicatos, buscar representação, unir-se a conselhos de
trabalhadores de acordo com a legislação local e a negociar
coletivamente com a empresa ou seus representantes.
The Supplier will respect the rights of workers to associate
freely, join or not join labor unions, seek representation, join
workers' councils in accordance with local law and to
bargain collectively with the company or its representatives.
O Fornecedor vai garantir que os representantes e qualquer
pessoa envolvida na organização de trabalhadores, não são
submetidos à discriminação, assédio, intimidação ou
represálias por serem membros de um sindicato ou por

The Supplier guarantees that the representatives and any
employee involved in organizing workers, are not subjected
to discrimination, harassment, intimidation or retaliation for
being members of a union or participating in union
activities, and that such representatives have access to their
affiliates in the workplace.

coletiva estejam restringidos por lei, serão projetados canais
apropriados para assegurar o exercício justo e

When the rights of freedom of association and collective
bargaining are restricted by law, appropriate channels
should be designed to ensure fair and independent practice.

5. Tratamento Justo
5. Fair treatment
O Fornecedor não vai permitir, não vai praticar, nem apoiar
atos de assédio físico, verbal, sexual ou psicológico, abuso ou
ameaças no local de trabalho. Vai definir políticas e
procedimentos disciplinares que deverão ser devidamente
comunicados a todos os trabalhadores e vai adotar medidas
para prevenir e reparar estes atos quando corresponda.
The Supplier will not tolerate, will not practice nor support
acts of physical, verbal, sexual or psychological harassment,
abuse or threats in the workplace. The Supplier will define
policies and disciplinary procedures to be properly
communicated to all working people and will take measures
to prevent such acts and repair where applicable.
6. Salários Justos

O Fornecedor vai assegurar que o procedimento de
contratação é justo e proporciona e proporciona um salário
digno a todos os trabalhadores cumprindo com todas as leis

The Supplier will ensure that the recruitment process is fair
and provides a living wage to all employed persons in
compliance with all applicable laws and industry standards
on wages, including those relating to minimum wages,
ensuring that are sufficient to meet basic needs and to offer
some discretionary spending capacity.

O Fornecedor vai assegurar que as condições de jornada de
trabalho, horas extras, permissões e as férias são justas e
não discriminatórias cumprindo com todas as leis aplicáveis
e as normas do setor sobre horas extras, feriados ou
benefícios obrigatórios por lei.
The Supplier will ensure that the conditions of the working
day, overtime, vacation and permissions are fair and
nondiscriminatory, in compliance with all applicable laws
and industry standards on overtime, holidays or benefits
required by law.

8. Conformidade regulatória
8. Regulatory Compliance
O fornecedor deve cumprir com todas as disposições da
regulamentação em matéria de segurança e saúde no
trabalho, em termos de pessoal ocupado direta ou
indiretamente, para a execução do contrato e assumirá total
responsabilidade por violação de deveres de trabalho,
acidentes de trabalho e violação da Legislação social. O
Fornecedor ainda se compromete a informar a Gamesa
qualquer acidente grave envolvendo empregado ou pessoal
terceirizado.
The Supplier will comply with all the provisions of the
regulations of Health and Safety at Work, regarding
personnel employed directly or indirectly, for the
implementation of the Contract and will assume all
responsibilities for failure to comply with work duties,
workplace accidents and breach of Labour Legislation. The
Supplier further commits to inform Gamesa of any serious
accident involving their personnel employed or contracted.
9. Condições de trabalho seguras

O Fornecedor irá garantir um ambiente de trabalho seguro e
saudável e irá adotar medidas efetivas para prevenir
potenciais acidentes e danos à saúde das pessoas que
trabalham resultante de atividades de trabalho decorrente
ou relacionado com, ou que surja durante a mesma,
minimizando – caso seja possível - as causas de perigos
inerentes ao ambiente de trabalho, e dado o conhecimento
atual da indústria e quaisquer perigos específicos.
The Supplier will ensure a safe and healthy workplace and
will take effective measures to prevent potential accidents
and injuries to the health of working people, arising from
working activities, associated with them, or arising during
that period, minimizing - to a reasonable extent- the root
causes of hazards inherent in the working environment,
given the current knowledge of the industry and of any
specific hazards.

10. Proteção Contra Risco
10. Protection against risks
O Fornecedor irá minimizar a exposição individual do
trabalhador a perigos potenciais para a segurança mediante
controles apropriados de desenho, engenharia e
administração, manutenção preventiva e procedimentos de
trabalho seguro e formação contínua sobre segurança.
The Supplier will minimize worker’s exposure to potential
safety hazards through appropriate design controls,
engineering control, preventive maintenance and safe
working procedures, and will provide ongoing safety
training.
Nos casos em que os perigos não possam ser controlados de
forma apropriada por estes meios, irá proporcionar aos
trabalhadores equipamentos de proteção pessoal que
estejam adequados e bem mantidos. Ele deve informar os
trabalhadores sobre os riscos específicos envolvidos no
desempenho do seu trabalho e as medidas preventivas
obrigatórias a serem tomadas para evitar, e entregar à
Gamesa uma cópia da carta enviada a cada trabalhador e
assinada por eles.
In cases where hazards cannot be properly controlled by
these means, the Supplier will provide to the workers
adequate and well-maintained personal protective
equipment. The supplier will notify in writing to the
employees of the specific hazards of the job performance
and the mandatory preventive measures to be taken to avoid
those hazards. Furthermore, Supplier will deliver to Gamesa
a copy of the letter issued to each worker and signed by
them.

11. Conformidade regulatória

O Fornecedor deverá cumprir todas as disposições das
normas ambientais referentes a geração e de gestão de
resíduos, emissões atmosféricas, ruídos e prevenção da
contaminação do solo.
The Supplier will comply with all the requirements of
environmental regulations regarding waste generation and
management, discharges, air emissions, noise and pollution
prevention of soil.
Ele também é responsável por atender todas as
regulamentações sobre a utilização e armazenagem de
produtos químicos nas áreas de trabalho ao longo da
execução do contrato e assumirá toda a responsabilidade
por violação das suas obrigações para com o meio ambiente.
The Supplier will also comply with all regulations on the use
and storage of chemicals in the working areas throughout
the execution of the Contract and will assume all
responsibilities for failure to comply its obligations to the
environment.
A Gamesa pode solicitar ao Fornecedor a cópia de todos os
documentos que comprovem o direito de gestão (contratos
com empresas de eliminação de resíduos, autorização e
registros de entrega, etc.) de resíduos.
Gamesa may request to the Supplier copies of all documents
that prove the right management (contracts with waste
disposal firms, authorization and delivery records, etc.) of
waste.
O fornecedor é responsável por informar imediatamente
todos os empregados das obrigações ambientais, por razões
legais, ou a pedido expresso da Gamesa adquiridos no
âmbito do contrato.
The Supplier will promptly inform all its employees of the
environmental obligations, by legal imperative or by express
request of Gamesa that are acquired under the contract.
12. Eficiência Energética
12. Energy efficiency
Com o objetivo de minimizar os consumos energéticos e
reduzir as emissões de gases de efeito estufa na atmosfera,
os fornecedores deverão reportar a Gamesa as emissões a
atmosfera correspondente aos produtos fornecidos
anualmente através do e-mail: corporate_ehs @
gamesacorp.com
In order to minimize energy consumption and reduce
greenhouse gases emissions to the atmosphere, the Supplier
will report to Gamesa the emissions to the atmosphere for
those products supplied annually to Gamesa, via email to:

13. Emergências Ambientais
13. Environmental Emergencies
O Fornecedor irá garantir que situações e eventos de
potencial emergência sejam identificados e avaliados, e seu
impacto minimizado pela implementação de planos e
procedimentos adequados de resposta a emergência.
The Supplier will ensure that potential situations of
emergency and emergency events are identified and
evaluated, and their impact minimized by implementing
emergency plans and procedures for response.

14. Materiais Fornecidos

Espera-se que os fornecedores da Gamesa sejam "DRC
conflict-free", ou seja, não irá fornecer produtos ou meios de
produção contendo estanho, tântalo, tungstênio e / ou ouro
da região a que pertencem na República Democrática do
Congo (DRC), República Centro Africano, Sudão do Sul,
Zâmbia, Angola, República do Congo, Tanzânia, Burundi,
Ruanda e Uganda. Caso contrário, o fornecedor irá notificar a
Gamesa quais minerais de conflito e quais produtos são
afetados.
The Supplier is expected to be "DRC conflict-free". That is,
provides no means of production or products containing tin,
tantalum, tungsten and / or gold from the region belonging
to the Democratic Republic of Congo (DRC), Central African
Republic, South Sudan, Zambia, Angola, Congo, Tanzania,
Burundi, Rwanda and Uganda. Otherwise the Supplier will

15. Corrupção e Suborno
15. Corruption and bribery
O Fornecedor não irá tolerar, não irá permitir nem se
envolver em nenhum tipo de corrupção, extorsão ou
suborno no desempenho das atividades empresariais. O
fornecedor deve garantir a manutenção dos padrões de
integridade mais elevados em todas as interações do
negócio, adotando uma política de tolerância zero para
proibir qualquer forma de suborno, corrupção, extorsão e
fraude (incluindo a promessa, oferta, concepção ou aceitação
de qualquer suborno).
The Supplier will not to tolerate, will not permit nor get
involved in any kind of corruption, extortion or bribery in
the performance of the business. The Supplier shall ensure
the maintenance of highest standards of integrity in all
business interactions, adopting a zero tolerance policy to
prohibit any form of bribery, corruption, extortion and
embezzlement (including the promise, offering, giving or
accepting of any bribe).
O Fornecedor deverá impedir qualquer atividade
fraudulenta por seus representantes em conexão com o
recebimento de qualquer quantia de dinheiro do comprador
ou de suas afiliadas.
The Supplier will prevent any fraudulent activity by any of
its representatives in connection with the receipt of any
amount of money from the Buyer or its affiliates.
O Fornecedor declara e garante em relação a qualquer
contrato com o comprador e qualquer empresa do seu
grupo: (i) não deu e não vai dar, qualquer presente ou
comissão, e (ii) que não tenha consentido, nem vai
concordar em pagar qualquer comissão a qualquer
empregado, agente ou representante do Comprador. Se o
fornecedor, ou aqueles que agem em seu nome, viola as
disposições do presente número, o Comprador pode (i)
rescindir todos os contratos com o fornecedor e / ou de suas
afiliadas e reivindicar o fornecedor por qualquer prejuízo
sofrido decisão causou, ou (ii) exigir que o fornecedor por
qualquer prejuízo sofrido pelo Comprador e / ou de suas
afiliadas, como resultado de qualquer violação desta seção,
se o contrato tiver sido objeto de resolução e se não o que
teria sido.
The Supplier warrants and undertakes in relation to any
contract with the Buyer and any group company: (i) it has
not given and will not give, any gift or commission, and (ii)
that has not agreed, and will not agree to pay any fee to any
Buyer’s employee, agent, servant or representative of Buyer.
If the Supplier, or anyone acting on its behalf, is in breach of
the foregoing provisions of this paragraph, the Buyer may (i)
terminate contracts with the Supplier and/or its affiliates
and recover from the Supplier any the amount of any loss
suffered by the Buyer resulting from such termination or (ii)
recover in full from the Supplier any loss sustained by the
Buyer and/or its affiliates as a result of any breach of this
section, whether or not the contract has been terminated.

O fornecedor deve assegurar que os procedimentos de
segurança e vigilância estão em conformidade com os
princípios de direitos humanos internacionalmente

forças de segurança pública e privada serão consistentes

The Supplier will ensure that security and surveillance
procedures are in accordance with internationally
recognized human rights principles on the implementation
of the law and the use of force. The security operations, as
well as collaboration with the public and private security
forces will be consistent with the laws of each country and
with international standards and guidelines as well as with
the Voluntary Principles on Security and Human Rights.
17. Concorrência Leal

O fornecedor irá manter padrões de negócios, publicidade e
concorrência leal e exercer a tributação responsável,
declarando os impostos e obrigações tributárias em prazo e
evitando dupla contabilização.
The Supplier will maintain fair competition standards of
business, advertising and to will exercise responsible
taxation, tax filing and paying obligations on time and
avoiding double counting.
18. Privacidade e Informação

O Fornecedor irá proteger todas as expectativas razoáveis
de privacidade das informações pessoais de alguém com
quem se faz negócio, incluindo fornecedores, clientes,
consumidores e dos trabalhadores.
The Supplier will protect all reasonable expectations of
privacy of the personal information of anyone involved in
business operations, including suppliers, customers,
consumers and workers.
19. Propriedade Intelectual
19. Intellectual Property
O fornecedor deve respeitar os direitos de propriedade
intelectual. A transferência de tecnologia e conhecimento
são feitas de uma forma que os direitos de propriedade
intelectual sejam protegidos.
The Supplier will respect the rights of intellectual property.
The transfer of technology and knowledge will be performed
so that the intellectual property rights are protected.
20. Comunidades Locais e Povos Indígenas

O Fornecedor irá consultar as comunidades locais sobre as
atividades, projetos, estratégias ou obras que afetam seus
territórios e suas vidas através de um processo de
Consentimento Livre, Prévio e Informado (FPIC) através de
procedimentos culturalmente apropriados. O Fornecedor irá
garantir a não participar nem beneficiar de deslocações
forçadas.
The Supplier will consult local communities about the
activities, projects, strategies or works affecting their
territories and their way of living through a process of Free
Prior and Informed Consent (FPIC) through culturally
appropriate procedures. The Supplier will ensure not to
participate nor benefit from forced relocations.
