CONTRATO DE COMPRA DE PROGRAMA DE INTERCÂMBIO PROFISSIONAL PARA OS EMIRADOS ÁRABES - versão 10/10 Pelo presente contrato, MCT TURISMO EPP , pessoa jurídica de direito privado, inscrita no CNPJ sob o nº 09.232.545/0001-06, cadastrada na EMBRATUR sob o nº 26.017321.10.0001-0 , com sede à Rua Congo , 41 – Jd Bonfiglioli – Jundiaí -SP- CEP 13.207-340 , neste ato CONTRATADA, e a pessoa física abaixo qualificada, de agora em diante denominada CONTRATANTE dos serviços abaixo delineados, têm estabelecido e acordadas as seguintes cláusulas e condições: Nome do CONTRATANTE: RG CPF Endereço completo Rua – Bairro Cidade /estado /CEPProfissão Data de Nascimento Natural de Celular Nacionalidade Tel. residencial : E-mail – Skype - CLÁUSULA PRIMEIRA - OBJETIVO A empresa CONTRATADA tem como finalidade assessorar o CONTRATANTE, o qual será usuário do site CREW.com.br , em conseguir uma oportunidade de Intercâmbio Remunerado ou Estágio Profissional nos Emirados Árabes , GCC e MENA . Para tanto, visando manter a integridade e o prestígio do site e de seus clientes, a CONTRATADA, estabelece os princípios básicos para o correto aproveitamento da assessoria contratada, da forma que passa a expor: CLÁUSULA SEGUNDA - DO VALOR Taxa de Adesão –R$ 950,00 para candidatas mulheres e R$ 1.600,00 para candidatos homens ser depositada no Banco Itaú – AG- 1951 – CC 13524-1 – fav MCT TURISMO EPP que pode A Taxa de Adesão remunera os custos de: Conseguir ao CONTRATANTE uma oportunidade profissional no exterior que ofereça os seguintes benefícios: a- Envio da passagem aérea b- Visto de trabalho c- Contrato de trabalho por dois anos d- Acomodação , alimentação e transporte ao trabalho grátis. Findo o prazo contratual, o mesmo não será prorrogado. Parágrafo - primeiro: O CONTRATANTE poderá rescindir o presente contrato, desde que seja por escrito , por motivos pessoais, desistência de viajar , gravidez ou doença na família e afins, por tanto sem direito ao ressarcimento da Taxa de Adesão. Parágrafo -segundo: O CONTRATANTE poderá solicitar, por escrito, via carta registrada , a suspensão por período indeterminado do presente contrato até estar pronto novamente para viajar sem qualquer custo adicional. Parágrafo – terceiro : O CONTRATANTE, declara expressamente aceitar as condições e termos do sistema operacional do MCT TURISMO EPP, e que já conversou com no mínimo 03 (três) usuários de sua escolha, que já se utilizaram dos serviços da CONTRATADA não podendo alegar o desconhecimento do sistema de trabalho da contratada. O USUÁRIO se responsabiliza pela veracidade das informações cadastrais e declara estar em condições físicas e psicológicas para viver no exterior e que terá que apresentar atestados médicos comprovando o seu estado de saúde quando exigidos pelo país de destino. CLÁUSULA QUARTA - DA DEVOLUÇÃO Os CANDIDATOS que não forem aprovados por nenhum hotel internacional dentro do prazo contratual, terão o valor da taxa de adesão integralmente ressarcida, desde que os mesmos informem semanalmente à CONTRATADA sobre o status de sua negociação internacional, ou seja, responda todos os e-mail enviados, informe as ligações internacionais recebidas e participe de reuniões e eventos promovidos pela CONTRATADA. Parágrafo – primeiro DA RESCISÃO CONTRATUAL – O CONTRATANTE poderá rescindir o contrato a qualquer momento, desde que seja comunicado por escrito por carta registrada com 30 dias de antecedência. CLÁUSULA QUINTA- DIREITO DE PROPRIEDADE A marca www.abudhabi.net.br e seus aplicativos são de propriedade da MCT TURISMO EPP, ficando vedado aos CONTRATANTES – nos termos da legislação em vigor – por qualquer maneira, transferir, ceder, locar ou sublicenciar os direitos de uso objeto deste contrato, obrigando-se a mantê-los sob sua guarda, de forma segura, não possibilitando que terceiros não cadastrados os utilizem, divulguem, explorem ou reproduzam por qualquer meio ficando sujeito a uma multa de cinco vezes o valor deste contrato. A CLÁUSULA SEXTA - DAS CONDIÇÕES GERAIS O CONTRATANTE, declara expressamente aceitar as condições e termos do sistema operacional da MCT TURISMO EPP, e que já conversou com no mínimo 03 (três) usuários de sua escolha, que já utilizaram os serviços da CONTRATADA, não podendo alegar o desconhecimento do sistema de trabalho da contratada. Parágrafo- primeiro : É responsabilidade do CONTRATANTE, participar dos eventos internacionais organizados pela CONTRATADA, assim como responder a todos as vagas enviadas em seu email. Sua responsabilidade limita-se a ASSESSORAR o CONTRATANTE, criando uma conta de e-mail @abudhabi.net.br , nela enviar semanalmente informações sobre cursos no exterior , intercâmbios , estágios, vistos, viagens e assuntos correlatos. Parágrafo-quarto: O CONTRATANTE, declara que estuda e analisa este contrato há mais de 10 (dez) dias e já consultou um Advogado antes de assinar este . Parágrafo-quinto: O CONTRATANTE autoriza o uso de seu nome e foto como cliente da CONTRATADA , na utilização interna ou externa na divulgação e promoção do sistema ou serviços. CLÁUSULA SÉTIMA - DO FORO As partes elegem o Foro da Comarca de Jundiaí-SP, para dirimir eventuais dúvidas ou litígios oriundos do presente instrumento, renunciando a qualquer outro por mais privilegiado que seja ou possa vir a ser. Assim sendo, por estarem justos e acordados, firmam o presente Contrato de Prestação de Serviços em 2 (duas) vias de igual teor e forma, juntamente com 2 (duas) testemunhas. Federal Labour Law, the latter will prevail. 1 Employer: XXXXXXXXXXXXXXXXXXXXXXX 2 Business Unit: 3 Position: 4 Salary: Dhs _______ per month 5 Your Employment will Commence on the date you report to work, which is currently contemplated to be: 6 Period of Employment Your term of employment is unlimited, commencing from the Date of Commencement of Employment. 7 Probationary Period Your employment is subject to the satisfactory completion of a six-month probationary period, during which time the Employer may terminate your employment without notice or end of service benefits. 8 Home Destination: 9 Grade: D 10 The Working Week You will be required to work a six-day, 48-hour week, exclusive of meal breaks. This means that your shift duration is 9 hours per day, rostered in accordance with the requirements of your department. There may be times when, due to business demand, you will be required to work shifts other than the 6-day, 9 hours per day arrangement. From time to time you may be requested to work overtime, which can either be paid or given as compensatory time off. Overtime must be agreed and approved in advance by your manager. 11 Place of Work The Employer reserves the right to reassign employees to other Business Units. A Business Unit is defined as any business in the Emirate of Dubai operated and / or managed by the Employer. Such assignments may be temporary or permanent. 12 Annual Leave Rua Congo , 41 – Jd Bonfiglioli - Jundiai-SP- CEP 13.207-340 – tel 11 4521 4090 - www.abudhabi.net.br 4 On completion of 12 months’ service, and annually thereafter, you will be entitled to 30 days’ annual leave, which includes working days and days off. Entitlements may be taken in the year following the year in which they are accrued and may not be carried over without the prior approval of your manager. The scheduling of leave will be mutually agreed where practical; in cases where agreement cannot be reached, your manager’s decision applies. 13 Public Holidays and Time in Lieu You will be entitled to public holidays for the private sector as decreed by the Government of Dubai. Should you work on a public holiday, you will be entitled to an alternative day off in lieu. 14 Sick Leave On completion of your probationary period, you will be eligible for paid sick leave. The entitlement is 15 days’ full pay and 30 days’ half pay per annum. Unused sick leave entitlements may not be carried forward. All sick leave must be processed in accordance with the Employer’s procedures. 15 Notice Period Should you wish to resign during or after your probationary period, you must give one month’s notice in writing. After completion of your probationary period, the Employer may give one month’s notice of termination of employment. The Employer reserves the right to pay basic salary, without any additional benefits, in lieu of notice. Your employment may be terminated without notice in cases of gross misconduct. 16 Policies and Procedures You will be subject to the policies, procedures, rules and regulations of the Employer, which may be amended from time to time. 17 Confidentiality / Conflicts of Interest Employees must not undertake trade or work that is in conflict with the interests of the Employer. You may not disclose information of a confidential nature to unauthorised persons within or outside the Company, during and after your employment with the Employer. By signing this Agreement, you agree to comply with the terms of the Employer’s Business Conduct and Ethics Policy, which may be amended from time to time. In accordance with the laws of the U.A.E., your work permit is issued under the sponsorship of the Employer and you may not work for another employer in a paid or unpaid capacity. 18 Accommodation The Employer will provide you with accommodation appropriate to your grade in accordance with the Employer’s Housing Policy, which may be amended from time to time. 19 Home Leave Tickets On completion of each 24 months’ service, you will be provided with a published excursion return ticket to your Home Destination. Tickets may not be cashed or accumulated beyond the calendar year in which they fall due, unless you were unable to proceed on home leave due to work requirements of the Employer. 20 Meals You are entitled to three meals per day, which may be taken in the colleague restaurant in your own SBU or at our employee housing in Al Quoz. For special occasions, with the prior approval of your Department Head, you may use hotel restaurants at 50% discount in accordance with the Employer’s Use of Facilities and Services Policy, which may be amended from time to time. 21 Uniform You will be provided with an employee uniform which is cleaned free of charge in the Employer’s laundry facilities. You will be required to adhere to the specific uniform/grooming standards of the Company. Please be guided by separate policies covering our grooming standards and seek clarification from you manager if in doubt. 22 Medical Expenses and Hospitalisation Medical and hospital treatment will be provided for you free of charge, in accordance with the Employer’s Medical Rua Congo , 41 – Jd Bonfiglioli - Jundiai-SP- CEP 13.207-340 – tel 11 4521 4090 - www.abudhabi.net.br 5 Policy. Chronic or pre-existing conditions must be declared prior to commencement of employment and will be assessed on a case by case basis. 23 Private Life and Accident Insurance The Employer provides insurance cover for you in the event of death, permanent or temporary disablement. Further details are available from your Human Resources Department. 24 Relocation (if your home destination is overseas) You will be provided with an economy-class flight from your Home Destination to Dubai. The ticket will usually be arranged and paid for by the Employer. If you arrange your own relocation flights, you must obtain prior approval from the Employer for the airfare cost 25 Repatriation Should you resign within the first 12 months of your employment, you will be responsible for costs of repatriation. You will be required to reimburse the Employer on a pro rata basis for the costs of relocation to the U.A.E, including incoming flight tickets, visa, medical and recruitment costs. Should you resign after 12 months’ service, you will not be required to reimburse relocation costs to the U.A.E. You will be responsible for relocation to your home destination. Should you leave the Employer after completing 36 months’ continuous service, at management’s discretion you may be provided with a one-way economy-class ticket to your Home Destination. 26 Termination On termination of employment, you will be paid all outstanding payments to which you are entitled, which are accrued until your last working day. You will be entitled to contractual benefits during and until the expiry of your notice period, whereupon such entitlement shall cease. If wages are being paid in lieu of notice, benefits will cease after your last working day. Please note that you are under the sponsorship of the Employer. On termination of your employment, you may be prevented from visiting or taking up further employment in the U.A.E. for a period of 6 - 12 months. Further details are available from your Human Resources Department. 27 End of Service Benefit You will be entitled to an end of service gratuity in accordance with the provision of U.A.E. Labour Law at the time of leaving. End of Service gratuity is forfeited in cases of dismissal for gross misconduct, leaving without notice or breaches of other conditions of the law appertaining to this provision. Please note that your passport will be held by the Employer for safekeeping and administration purposes during your employment, on the understanding that you shall be provided with the passport temporarily should you reasonably require it to proceed on leave or for the administration of any formal applications to government departments or local authorities. Your appointment is subject to passing a medical examination in Dubai, the receipt of satisfactory employment references, the receipt of proof of educational and professional qualifications, and the granting of an employment visa by the authorities in Dubai, U.A.E.
