The Human Rights Committee
•  ICCPR adopted in 1966, entry into force in 1976
•  168 state parties in 2014
•  Monitoring body
–  Human Rights Committee – HRC (ICCHR art. 28-45)
•  The Committee’s four main functions:
–  Consideration of states reports (ICCPR art. 40)
–  Adoption of ‘general comments’ (ICCPR art. 40)
–  Examination of ‘communications’ from individuals (ICCPR OP
1 art. 40)
–  Interstate complaints procedure (ICCPR art. 41 and 42)

ICCPR First Optional Protocol
•  “To achieve the purposes of the International Covenant on Civil
and Political Rights […] and the implementation of its provisions it
would be appropriate to enable the Human Rights Committee […]
to receive and consider, […] communications from individuals
claiming to be victims of violations of any of the rights set forth in
the Covenant” (preamble)
•  Entry into force March 1976
•  State Parties: 114 (of the 168 state parties to the ICCPR)

Primeiro Protocolo Adicional
•  “Para melhor assegurar o cumprimento dos fins do
Pacto Internacional sobre Direitos Civis e Políticos […]
e a aplicação das suas disposições, conviria habilitar
o Comité̂ de Direitos Humanos […] a receber e
examinar, como se prevê no presente Protocolo, as
comunicações de indivíduos particulares que se
considerem vitimas de uma violação de quaisquer dos
direitos enunciados no Pacto” (preâmbulo)

Admissibility
• 
Individuals “who claim to be victims of a violation by that State
Party of any of the rights set forth in the Covenant” (art. 1)
• 
“Individuals who claim that any of their rights enumerated in
the Covenant have been violated and who have exhausted
all available domestic remedies may submit a written
communication to the Committee for consideration” (art. 2)
• 
Inadmissible: anonymous communications, or which the
Committee “considers to be an abuse of the right of
submission of such communications or to be incompatible with
the provisions of the Covenant” (art. 3)

Admissibilidade

Indivíduos “que aleguem ter sido vítimas de uma violação, por
esses Estados-Partes, de quaisquer dos direitos enunciados no
Pacto” (art. 1)

“O indivíduo que se considerar vítima de violação de qualquer
dos direitos enunciados no Pacto e que tenha esgotado todos os
recursos internos disponíveis, poderá́ apresentar uma
comunicação escrita ao Comité para que este a examine” (art. 2)

Inadmissíveis: que sejam anónimas, ou que, “a seu juízo,
constituam abuso de direito ou sejam incompatíveis com as
disposições do Pacto” (art. 3)

Procedure
•  A written communication is submitted by the individual to the
Committee for consideration (art. 2)
•  The Committee considers
–

If the communication is inadmissible (art. 1, 2, 3, 5), if not:
The content of the consideration
•  The procedure is written and confidential
•  The Committee registers and sends the communication for response/
explanations (art. 4)
•  The Committee considers the communication in light of the received
information. All information for the Committee is written, no
independent fact-finding (art. 5)
•  The Views of the Committee is forwarded to the State party and the
individual (art. 5.4)

Procedimento
•  Poderá́ apresentar uma comunicação escrita ao Comité para que
este a examine (art. 2)
•  O Comité analisará
–  Se a comunicação é admissível (art. 1, 2, 3, 5), se não:
–  O conteúdo da consideração
•  O procedimento é escrito e confidencial
•  O Comité regista e leva a conhecimento para explicações ou
declarações (art. 4)
•  O Comité examinará as comunicações recebidas tendo em conta
todas as informações escritas que lhe forem submetidas pelo
indivíduo, sem investigações autónomas (art. 5)
•  O Comité comunicará seu parecer ao Estado-Parte interessado e ao
indivíduo. (art. 5.4)
