HUMANOS NA ESFERA REGIONAL

Resumo
A proteção aos direitos humanos ocorre em duas esferas: universal e regional. Na
esfera regional a competência cabe à Organização dos Estados Americanos através
da Comissão Interamericana de Direitos Humanos e da Corte Interamericana de
Direitos Humanos, que recebe denuncias do descumprimento da Convenção Americana de Direitos Humanos e demais tratados firmados nesse plano. O Brasil é Estado
Parte da OEA e reconhece esse sistema regional de proteção aos direitos humanos.
O objetivo desse trabalho é apresentar o dinâmica funcional desse sistema bem
como a participação do Brasil nessa esfera observando se o Estado brasileiro está
cumprindo com as determinações que lhe foram feitas, pois o problema está no
descumprimento das normas internacionais em que o Estado se propôs a respeitar
quando firmou tratados sobre a matéria. O método de abordagem utilizado é o indutivo e o de procedimento o bibliográfico e documental.

Abstract
The protection of human rights occurs in two spheres: universal and regional. In the
regional competence lies with the Organization of American States through the Inter-American Commission on Human Rights and the Inter-American Court of Human
Rights, which receives complaints of violation of the American Convention on Human
Rights and other treaties signed that plan. Brazil is a State Party to the OAS and
acknowledges this regional system of human rights protection. The aim of this paper
is to present the functional dynamics of this system as well as Brazil's participation in
this sphere observing whether the Brazilian State is complying with the determinations that have been made since the problem is in breach of international standards
where the State proposes to respect when signed treaties on the matter. The method
used is the inductive approach and procedure of the bibliographic and documentary.
