THE PROCEDURE IN THE NATIONAL PHASE

BR.01 FORM FOR ENTERING THE NATIONAL PHASE. The Office has available a
form for the transmittal of documents for entering the national phase (“Form FQ003”, see
Annex BR.II). This form should preferably be used.
BR.02 TRANSLATION (CORRECTION). Errors in the translation of the international
application can be corrected with reference to the text of the international application as filed.
BR.03 FEES (MANNER OF PAYMENT). The manner of payment of the fees indicated in
the Summary and in this Chapter is outlined in Annex BR.I.

BR.04 INSTRUMENT OF ASSIGNMENT. Legalization is not required. If the instrument
of assignment is not in Portuguese, a certified translation thereof into Portuguese must be
furnished at the same time.

BR.05 POWER OF ATTORNEY. An agent must be appointed by filing a power of
attorney. A model is given in Annex BR.III.

BR.06 ANNUAL FEES. They are payable within three months from the second and each
subsequent anniversary of the international filing date. If the three-month period ends before
the expiration of the time limit applicable for entering the national phase, the payment of the
first annual fee may be made within three months after the expiration of that time limit.
Payment can still be made during six months after the expiration of the three-month period. The
amounts of the annual fees are indicated in Annex BR.I.

BR.07 REQUEST FOR EXAMINATION. A patent will be granted only after examination
as to patentability which may be requested by the applicant or by a third party. The request for
examination must be made in Portuguese on the General Procedural Request Form
(“Form 1.02”) reproduced in Annex BR.IV.

An applicant may request prioritized examination of an application where the applicant is over
sixty years of age and:
(i) claims in the application are being infringed; or
(ii) grant of patent is a condition for obtaining funding.

Prioritized examination may also be available to the applicant or interested third parties where
an application concerns the diagnosis, prevention or treatment of AIDS/HIV, cancer or
neglected diseases related to public health. There is no additional fee.

BR.08 TIME LIMIT FOR REQUESTING EXAMINATION. Examination must be
requested within 36 months from the international filing date or within 60 days from the entry
into the national phase.
BR.09 FEE FOR REQUESTING EXAMINATION. The request for examination is only
effective if a fee for requesting examination has been paid. The amount of the fee is indicated in
Annex BR.I.

BR.10 FEE FOR GRANT. A fee for issue of the patent must be paid within 60 days after
the publication in the Gazette of the Office (Revista da Propriedade Industrial) of the decision
to grant the patent. The fee may also be paid within 30 additional days, subject to a surcharge.

BR.12 REVIEW UNDER ARTICLE 25 OF THE PCT. The applicable procedure is
outlined in paragraphs 6.018 to 6.021 of the National Phase. If, upon review under PCT Article
25, the Office denies an error or omission on the part of the receiving Office or the International
Bureau, an appeal against this decision may be lodged within 60 days from the date of the
publication of the decision in the Gazette of the Office (Revista da Propriedade Industrial).
The appeal is subject to the payment of an appeal fee (for the amount, see Annex BR.I). The
President of the Office will then decide on the appeal.

BR.13 EXCUSE OF DELAYS IN MEETING TIME LIMITS. The Office does not
excuse the failure to comply with a time limit, neither during the international phase nor during
the national phase, unless otherwise specified in this Chapter, although, in specific cases
considered as force majeure cases, the delay may be excused.

BR.14 UTILITY MODEL. Subject to what is said in paragraph BR.16, if the applicant
wishes to obtain a utility model instead of a patent in Brazil, on the basis of an international
application, for international applications filed before 1 January 2004, this must have been
indicated in the international application (in Box No. V of the request) when filed and must be
indicated on the form for transmittal (if used) which is referred to in paragraph BR.01; for
international applications filed on or after 1 January 2004, since the request form no longer
provides for the furnishing of such an indication, the applicant, when performing the acts
referred to in Article 22 or 39, shall so indicate to the Office.

BR.15 The requirements for the national phase are basically the same as for patents, except
that the fees for utility models must be paid.
BR.16 CONVERSION. An international application for a patent may be converted into a
utility model application at any time after the applicant has performed the acts for entering the
national phase indicated in the Summary and before the publication of the decision to grant a
patent. The request for conversion must be made in writing with reference to the national
application number and be accompanied by the General Procedural Request Form (“Form 1.02,”
see Annex BR.IV) and the payment of the general procedural fee, the amount of which is
indicated in Annex BR.I.

How can payment of fees be effected?
The payment of fees must be effected in Brazilian reais through any agency of the Banco do Brasil in Brazil
by using a special form for payment of fees called “Guia Electrônica” which can be obtained from the Internet at
www.inpi.gov.br.

Este procedimento trata do preenchimento do formulário DIRPA FQ103 – PCT
Entrada na Fase Nacional.
2. CAMPO DE APLICAÇÃO
Este procedimento se aplica a todos os usuários que solicitarem a entrada na fase
nacional de um pedido internacional depositado via PCT – Tratado de Cooperação
em Matéria de Patentes.
Este formulário também pode ser utilizado para requerimento do restabelecimento
de direitos para entrada na fase nacional.

Gerar e pagar a Guia de Recolhimento da União (GRU) correspondente ao
serviço solicitado, conforme instruções disponibilizadas na página do INPI
na Internet, www.inpi.gov.br.
O depositante deve apresentar a respectiva GRU referente à entrada na
fase nacional (código de serviço 200) e, se for o caso, a GRU referente ao
requerimento de restabelecimento de direitos para entrada na nacional do
PCT (código de serviço 271).
Preencher o formulário sem rasuras ou emendas, se manuscrito, usar tinta
preta, indelével e letra de forma legível.
Imprimir o formulário, mantendo todas as suas características, tais como o
padrão de três (03) folhas, em papel A4 e tinta preta.
Entregar o formulário na Recepção do INPI no Rio de Janeiro, nas Divisões
Regionais ou Representações, no mínimo de duas (02) e no máximo de
três (03) vias, duas para o INPI e outra para ser devolvida ao depositante.
O formulário pode ser apresentado através de envio postal, com aviso de
recebimento, endereçado à Diretoria de Patentes – DIRPA.
O Relatório Descritivo, Reivindicações, Resumo, Desenhos (se houver) e
Listagem de Seqüência em formato impresso (se houver) devem ser
entregues no mínimo de duas (02) e no máximo de três (03) vias, duas para
o INPI e outra para ser devolvida ao depositante na Recepção do INPI no
Rio de Janeiro, nas Divisões Regionais ou Representações, ou através de
envio postal, com aviso de recebimento, endereçado à Diretoria de
Patentes – DIRPA.

5.1 Campo 1 – Depositante
Preencher com o nome completo do depositante, qualificar com a profissão ou a
natureza jurídica, indicar o CNPJ ou CPF, se aplicável, endereço completo, CEP,
telefone e fax, indicando o código de área, e e-mail. Caso haja mais de um
depositante, assinale "continua em folha anexa" e preencha, todos os dados,
conforme explicitado para o primeiro depositante.
5.2 Campo 2 – Natureza
Assinale a natureza (invenção ou modelo de utilidade), do pedido que está sendo
depositado.

5.5 Campo 5 – Prioridade Unionista
Caso esteja sendo reivindicada prioridade de depósito anterior, informe o nome ou
sigla do país ou organização, o número e a data da prioridade. Se precisar de
mais espaço, forneça os dados em folha anexa.
5.6 Campo 6 – Inventor
Preencher com o nome completo do inventor, qualificar com a profissão ou a
natureza jurídica, indicar o CNPJ ou CPF, se aplicável, endereço completo, CEP,
telefone e fax, indicando o código de área, e e-mail. Caso haja mais de um
inventor, assinale "continua em folha anexa" e preencha todos os dados, conforme
explicitado para o primeiro inventor.
5.7 Campo 7 – Declaração de divulgação anterior não prejudicial.
Informar, se for o caso, os dados relativos à divulgação ocorrida dentro do prazo
de 12 (doze) meses anteriores à data de prioridade ou data de depósito do pedido
internacional PCT, quando não houver reivindicação de prioridade. Assinale a
quadrícula apropriada se estiver anexando comprovantes, os quais deverão ser
listados no item 11.15 (Outros documentos anexados).
5.8 Campo 8 – Procurador.
No caso de haver sido nomeado um procurador, forneça aqui os seus dados. Não
residentes precisam constituir e manter um procurador residente no Brasil.
5.9 Campo 9 – Listagem de Seqüências Biológicas (documentos
anexados).
Caso o pedido de patente contenha listagem de seqüências biológicas, assinalar a
quadrícula e informar, nos itens 11.9 a 11.12 do Campo 11 “Documentos
Anexados” os documentos que estão sendo apresentados junto com este

5.10 Campo 10 – Restabelecimento de direitos para entrada na fase
nacional.
Assinalar a quadrícula caso o pedido de patente contenha requerimento para
restabelecimento de direitos para entrada na fase nacional e informar as razões
itens 11.13, 11.14 ou ambos, do Campo 11 “Documentos Anexados”, desde que
se enquadram nas alegações apresentadas no corpo da petição de entrada na
fase nacional.
5.11 Campo 11 – Documentos Anexados.
Assinalar quais os documentos que estão sendo apresentados junto com este
formulário. Caso sejam apresentados anexos ou outros documentos que não os
especificados, assinalar o item 11.15 “Outros”. Indicar o número de folhas de cada
um dos documentos. O número de folhas deverá incluir somente o de uma das
vias de cada documento.
5.12 Campo 12 – Total de folhas deste pedido.
Indicar o número total de folhas apresentadas (somente uma das vias de cada
documento).
5.13 Campo 13 – Data e assinatura.
Datar e assinar, carimbando ou escrevendo de forma legível seus dados,
incluindo, se for o caso o número de API.
