BIOGRAPHICAL NOTE
Dr José H. Fischel de Andrade is a graduate of the universities of Brasília and São
Paulo, Brazil, where he studied Law (LLB), International Law (LLM) and History of
International Relations (PhD). He further read International Relations (MSt), and is
reading Politics & International Studies (PhD) at the University of Cambridge. He also
obtained the Diplomas of the Academy of European Law-EUI in Firenze, the
International Institute of Human Rights in Strasbourg, and the Raoul Wallenberg Institute
of Human Rights and Humanitarian Law in Lund.
He was awarded various visiting and research fellowships, including those of CNPq
Junior Researcher at the University of Brasília, Visiting Scholar at the Universities of
Nottingham and Milano, Doctoral Researcher at The Hague Academy of International
Law – where he also attended the Centre for Studies and Research in International Law
and International Relations –, and CAPES Post-Doctoral Research Fellow at The
Graduate Institute (HEID) in Geneva.
José is a Professor (a contratto) in International Refugee and Human Rights Law at the
University of Milano (Statale) and was formerly a Lecturer in International Law at the
University of Brasília. He has taught short courses at the International Institute of
Humanitarian Law in Sanremo, the International Institute of Human Rights in Strasbourg,
the OAS Inter-American Juridical Committee in Rio de Janeiro, and the Center of
International Law (CEDIN) in Belo Horizonte. He has also been a guest lecturer at
conferences and seminars organised by the UNHCR, the ICRC, the International
Association of Refugee Law Judges (IARLJ), the International Bar Association (IBA)
diplomatic academies, universities, and academic institutions and organisations in
Argentina, Brazil, Colombia, Costa Rica, Denmark, Ecuador, England, France, Germany,
Italy, Peru, Portugal, South Africa, Spain, Switzerland, Thailand and Venezuela.
He is a senior staff member of the UNHCR where he has been serving since 1995
principally in legal and managerial positions in several countries, such as Brazil,
Venezuela, Bosnia-Herzegovina, Switzerland (at HQ), Chad and France. He has also
been on various types of missions (emergency, training, fact-finding, protection audit,
refugee status determination) to Algeria, Argentina, Cambodia, Chad, Colombia,
Dominican Republic, Egypt, Ecuador, Liberia, Morocco, Mauritania, Panama, Pakistan,
Peru, Portugal, Thailand and Turkey. Since 2013 he is a UNHCR-designated judge at the
French National Asylum Court (CNDA), an administrative second instance specialised
asylum court based in Paris.
José has written extensively on forced migration, human rights, international
organizations, and international law.
He speaks Portuguese, German, French, English, Spanish, and Italian.

From February 2008 through February 2010, I was the Head of the UNHCR in Goz Beida, Chad, and was
responsible for: (i) implementing the Country Office's strategic operational framework concerning refugees and
IDPs in accordance with the international norms and the priorities of the High Commissioner, and seeking durable
solutions; (ii) reinforcing the understanding of the partnership with international actors (UN agencies, EUFOR,
MINURCAT and NGOs) in FO-Goz Beida's Area of Responsibility (AoR), so that UNHCR's mandate is better
understood, supporting the operation objectives, and protecting and assisting the persons of concern of the
Office; (iii) coordinating and negotiating all questions related to protection and assistance of refugees, IDPs and
returnees with local and regional authorities, including security issues; and (iv) handling properly the managerial
(in particular administrative and financial) matters of FO-Goz Beida and Field Unit Koukou, as well as the
resources and staff, including the co-ordination and supervision of 36 staff members, training activities,
compliance with MOSS and MORSS, and improvement of working and living conditions.
• Refugee Status Determination (RSD) Field Advisor (P-3), Genève, Switzerland (Mar. 2005 – Feb. 2008)
From March 2005 to February 2008, I served as a Refugee Status Determination (RSD) Field Advisor for the
UNHCR's Division of International Protection Services (DIPS), a division responsible for the legal issues and staff
support related to refugee protection. During my assignment I have: (i) prepared various judicial briefings (amicus
curiae) and other legal documents; (ii) managed case files concerning applications for refugee status before
national courts and migration services; (iii) managed and reviewed legal research and other assignments of
colleagues under my supervision; (iv) provided high-level assistance to my supervisors and prepared caserelated and legal documents; (v) drafted diplomatic, administrative and general correspondence; (vi) prepared
speeches for heads of missions in various countries; and (vii) collaborated with and provided legal support to
numerous UNHCR field offices in different continents. My duties have also included: (viii) responsibility for the
deployment of RSD Officers under the RSD Project; (ix) managing the Emergency Roster of RSD Officers; (x)
drawing leassons learned and concept papers and keeping track of deployment statistics; (xi) developing and
delivering training activities; and (xii) establishing an "RSD Community of Practices".
• Head of Office (P-3), Bahai, Chad (Aug. – Dec. 2004) (mission)
During the five month period during which I worked in Bahaï, Chad, on an emergency mission, my duties
included: (i) assuming responsibility as Officer in Charge (OIC) for the management of UNHCR Field Office (FO),
in Bahai; (ii) managing the administrative and financial matters of the office, as well as its resources and staff,

including the coaching and supervision of 10 (ten) national staff and 02 (two) UNVs; (iii) monitoring the overall
situation and assessing the protection and assistance needs of and activities for refugees of the Oure Cassoni
refugee camp and refugees in the border area, ensuring that the highest standard of legal and physical protection
was accorded to the refugees and that particular attention was given to the protection needs of the vulnerable
groups including women, children, the disabled and the elderly; (iv) developing relations and maintaining
constructive dialogue with Venue authorities, operational partners and refugee leaders, ensuring smooth
negotiations in all aspects of UNHCR's mandate for the benefit of refugees; and (v) providing assistance to
UNHCR technical advisers and/or consultants, as well as visitors (media, donors &c) visiting projects sites.
• Head of Office (P-3), Gorazde, Bosnia-Herzegovina (Feb. 2000 – Jan. 2001)
During the one year I was in charge of the UNHCR office in Gorazde, Bosnia-Herzegovina. My duties included (i)
ensuring that all actors at the field level understood and respected UNHCR's key role as the lead-agency, both in
protection of internationally displaced persons [IDPs] and returnees, and in facilitating, catalyzing, and supporting
returns; (ii) assessing the potential return movements and providing UNHCR expertise, both with regard to
protection and assistance, in the pre-return phase and in the reintegration phase; (iii) ensuring that IDPs
exercised their right to repossess their pre-war property through the Property Law Implementation Plan process,
as a means to enable their enjoyment of a durable solution; (iv) gathering information and drafting and regularly
up-dating a Contingency Plan, to be implemented in the UNHCR Gorazde's area of responsibility (AoR) in case
an influx of asylum-seekers is produced; and (v) managing the administrative and financial matters, as well as the
resources and staff of UNHCR Office in Gorazde, including the co-ordination and supervision of eight staff
members, interns and Camp Sadako participants.

The UNHCR office in Caracas has regional jurisdiction. Therefore my activities were discharged not only in
Venezuela but also in Panama, Colombia, Ecuador and Peru. I was charged with (i) undertaking missions in the
border areas of the countries covered by the Regional Office (RO-VEN) with a view to (a) monitoring the situation
of forced displacement into asylum countries, (b) establishing contacts with, and explaining UNHCR mandate to,
authorities and interlocutors, and (c) preparing accurate and comprehensive reports followed by
recommendations for follow-up activities; (ii) carrying out eligibility interviews of asylum-seekers and preparing
the corresponding eligibility legal opinions; (iii) participating in the RO-VEN’s training, promotion and
dissemination; and (iv) assisting in organizing a stock-taking and up-dating the legislation of the countries
covered by the RO-VEN.
. During the two-year period I was assigned to and worked in Venezuela I went on mission to Vahun (Liberia)
from April to May 1998, and to Bogotá (Colombia) from July 1998 to January 1999.

During the three years I worked in Brazil I was charged with (i) protecting refugees and other persons of concern

integration); (ii) drafting and lobbying for the Refugee Act, which was passed as legislation in July 1997; (iii)
training the National Committee for Refugees (CONARE) members and supervising its decisions, so that these
reflect UNHCR protection and assistance objectives; and (iv) training the refugee eligibility interviewers who, on
behalf of the government and of the civil society, prepare the eligibility opinions regarding new asylum seekers
and provide, to them and to recognized refugees, legal assistance.
