TERMOS E CONDIÇÕES PARA INSCRIÇÃO
1.
Informações preliminares
1.1.
A competição “The Ultimate Gap Year – Queensland Australia” (“Competição”) é
realizada pelo estado de Queensland através da Trade and Investment Queensland,

cadastro de pessoa jurídica australiana 93 887 376 875 (o “Estado”).
As informações sobre como se inscrever e os prêmios fazem parte desses Termos e

Condições para Inscrição (“Termos e Condições”).
Ao enviar o formulário de inscrição oficial preenchido do “The Ultimate Gap Year –

Queensland Australia”, o “Candidato” aceita os Termos e Condições.
A Competição tem início às 00:01 (AEST) da sexta-feira, 21 de março de 2014. As
inscrições serão encerradas às 23:59 (AEST) do sábado, 31 de maio de 2014 (“Data de
Encerramento”). O Candidato deve determinar as datas e horários de início e
encerramento locais com base em seu fuso horário.
2.
O prêmio
2.1.
Ao se inscreverem na competição, os Candidatos Elegíveis têm a chance de ganhar um
dos seguintes prêmios:
2.2.
(a)
Um Pacote de Primeiro Prêmio para um Candidato de cada País Participante
(b)
(“Vencedor”).
Dois prêmios de vice-campeão para dois Candidatos de cada País Participante
(os “Vice-campeões”).
Os Pacotes Específicos de Prêmio para cada País Participante estão descritos abaixo e
podem ser encontrados com maiores detalhes no Anexo A:

3.
Condições do prêmio
3.1.
Condições para os vencedores
(a)

Todo o transporte terrestre e as reservas de voos estão sujeitos à
disponibilidade. O Estado reserva-se ao direito de revisar o prêmio em casos de
circunstâncias não previstas.
O Vencedor deve chegar em Queensland no máximo até 30 de setembro de
2014 e deixar a Austrália no máximo até 31 de agosto de 2015.

O Vencedor deve atender às exigências para o visto australiano.
O Prêmio exclui seguro de responsabilidade civil (exceto durante o estágio),
cobertura para despesas odontológicas e de saúde, excesso de bagagem,
refeições, impostos, despesas acessórias, passeios, transporte terrestre,
traslados de/para aeroporto no país de origem, serviço de quarto e todos os
outros custos de natureza pessoal não descritos no Anexo A.
(e)
A viagem associada ao Prêmio está sujeita à disponibilidade no momento da

reserva.
O Estado organizará todas as reservas de voo. Todas as alterações e despesas
incorridas após a emissão dos bilhetes aéreos serão de responsabilidade
exclusiva do Vencedor.
(g)
As passagens aéreas não têm valor monetário e as partes não utilizadas não
podem ser resgatadas em dinheiro. Não serão creditados pontos de programas
de milhagem nessas passagens.
(h)
O Estado não é responsável por quaisquer alterações no valor do Prêmio que
possam vir a ocorrer entre a data de publicação e a data de reivindicação do
(i)
prêmio.
Os prêmios são não podem ser transferidos nem trocados e não podem ser
(j)
retirados em dinheiro.
O Estado não faz reclamações formais com relação a qualidade ou
funcionalidade de qualquer prêmio, nem endossa os prêmios ou qualquer parte
(k)
à ele associada.
O componente estágio do Prêmio deve ocorrer após o Vencedor concluir todos
os cursos que fazem parte do Prêmio, devendo:
(i)
ter um visto de trabalho válido para trabalhar na Austrália;
(ii)
garantir que o estágio ocorre em uma área diretamente relacionada à
área de formação do Vencedor;
(iii)
ter habilidades intermediárias – avançadas de inglês (equivalente a
(iv)
IELTS 5.0 ou superior) para poder participar do estágio e
fornecer um currículo atualizado incluindo uma foto colorida, carta dos
objetivos do estágio e tradução certificada do histórico escolar.
O pagamento recebido durante o estágio estará de acordo com as leis trabalhistas de
Queensland. Pode ser necessário que o Vencedor pague imposto de renda na Austrália
sobre este valor.

3.2.
Condições para os Vice-Campeões
(a)

O vice-campeão deve atender à todas as exigências para o visto australiano.
Cada vice-campeão deve fazer o pagamento de todos os gastos, incluindo
transporte terrestre, acomodação e voos que sejam diferentes dos constantes do
Anexo A.
(c)
Os prêmios são não podem ser transferidos nem trocados e não podem ser
retirados em dinheiro.
(d)
O Estado não faz reclamações formais com relação a qualidade ou
funcionalidade de qualquer prêmio, nem endossa os prêmios ou qualquer parte
à ele associada.
(e)
Todos os cursos devem começar após 1º de setembro de 2014 e serem
concluídos antes de 31 de agosto de 2015, salvo ressalvas em contrário.
4.
Elegibilidade
4.1.
A inscrição na Competição está aberta para todas as pessoas com idades entre dezoito

e trinta anos até 21 de março de 2014.
Os candidatos devem ser cidadãos do Brasil (“País Participante”).
4.3
4.4
Os cidadãos australianos, residentes permanentes e estudantes internacionais que
estudam ou já estudaram na Austrália anteriormente, de qualquer forma, ficam excluídos
da participação nesta Competição.
Os candidatos devem ter passaporte válido, atender aos requisitos legislativos do visto
para a Austrália (consulte: http://www.immi.gov.au) e estar disponíveis para visitar a
Austrália durante o período entre setembro de 2014 e agosto de 2015, caso seja um
Vencedor ou Vice-campeão.
4.5
O candidato não pode ter sido condenado por qualquer infração penal e não pode ter
tido visto negado ou ter sido deportado de Austrália ou de qualquer outro país.
4.6
Os candidatos autorizam o Estado a consultar os antecedentes civis, criminais,
financeiros e outros, bem como fazer referências cruzados quando necessário ou
desejável pelo Estado.
4.7
Diretores, gerentes, funcionários e terceirizados do Trade and Investment Queensland,
todas as agências e fornecedores relacionados a Competição (e seus familiares diretos)
não podem participar. “Familiares diretos” refere-se aos cônjuges, pais, filho biológico ou
adotivo e irmãos (seja de pais biológicos ou adotivos), independente de viverem no
mesmo domicílio do diretor, gerente, funcionário ou terceirizado.

5.
Como participar
5.1
Para participar e ter elegibilidade para ser um vencedor ou vice-campeão da Competição,
os Candidatos deve, antes da Data de Encerramento:

(www.facebook.com/queenslandgapyear);
preencher o formulário oficial “The Ultimate Gap Year – Queensland Australia”
(“Inscrição”) informando o nome completo de acordo com o passaporte e
fornecer um link do YouTube da Inscrição (“Vídeo”) sobre como promover e fazer
blogs sobre Queensland.
Para o Vídeo ter a inscrição validada, ele deve:
(a)
(b)
estar em inglês;
ter duração de até 60 segundos;
(c)
ser recebido até a Data de Encerramento. Qualquer vídeo recebido após esta data,
por qualquer motivo, incluindo o fato de a inscrição ter sido perdida, atrasada ou
não direcionada, pode não ser aceito à critério absoluto do Estado. Não nos
(d)
responsabilizamos por Inscrições atrasadas, perdidas ou não direcionadas;
não deve conter nenhuma empresa ou marca de produto (incluindo URLs ou
(e)
números de telefones) mesmo que exista permissão de tal organização;
não ser ilegal ou fraudulento, de modo que o Estado possa considerar (com base
em seus próprios critérios) como violando propriedades intelectuais, privacidade,
publicidade ou outros direitos;
(f)
não ser difamatório, falso ou conter comentários depreciativos sobre outras
(g)
pessoas ou empresas;
conter qualquer tipo de identificação pessoal, como números de placa de
(h)
automóveis, nomes pessoais, endereços de e-mail ou endereços residenciais;
não ser obsceno, pornográfico, profano, sexualmente inadequado, violento,
abusivo, assediante, ameaçador, censurável ou depreciativo do ponto de vista de
qualquer etnia, raça, sexo, religião, grupo profissional ou faixa etária;
(i)
não incluir nudez, profanidade ou obscenidade, nem ser considerado inadequado

para publicação;
não promover drogas ilegais, tabaco, armas de fogo nem qualquer atividade que
possa parecer insegura ou perigosa ou promover qualquer pauta ou mensagem
política em especial; caça ou jogatina, crueldade com animais ou humanos, ou
(k)
consumo irresponsável de álcool;
poder ser visualizado sem problemas técnicos;
(l)
ter 100 votos registrados. A inscrição vencedora não será necessariamente a do
Vídeo com maior número de votos. O Candidato poderá atrair votos para seu
Vídeo convidando amigos para votar e ganhando votos de bônus ao assistir os
(m)
vídeos de patrocinadores e curtir páginas de patrocinadores no Facebook e
conter as informações de contato do Candidato, que devem permanecer corretas
e atualizados através da página da Competição no Facebook. Caso contrário, o
Estado poderá dar o Prêmio para outro Candidato.

6.
Decisão
6.1
Os Candidatos pré-selecionados serão julgados pelos representantes nomeados pelo
estado de Queensland quanto a originalidade, criatividade e capacidade de incorporar os
temas de Queensland, que devem promover Queensland e identificar como o “gap year”

em Queensland beneficiaria a carreira do Candidato.
Os Candidatos pré-selecionados devem enviar um currículo com referências. O
currículo deve incluir formação educacional, experiência profissional e outras habilidades.
Devem ser fornecidas pelo menos 3 referências, incluindo uma acadêmica, uma
profissional e uma pessoal.
6.3
A decisão dos julgadores dos Candidatos pré-selecionados ("Pré-selecionados") será
feita e anunciada em 16 de junho de 2014. A lista de pré-seleção será divulgada
publicamente através da página da Competição no Facebook
(www.facebook.com/queenslandgapyear). A quantidade de Candidatos na lista de préseleção fica à critério do Estado.
6.4
6.5
Os Candidatos pré-selecionados serão contatados para fazer uma entrevista. As
entrevistas serão realizadas em inglês apenas entre os dias 23 de junho e 4 de julho de
2014 através de um software de conferências on-line.
O Vencedor e os Vice-campeões de cada país participante serão anunciados em 7 de
julho de 2014. A decisão do Estado sobre os Vencedores e Vice-campeões da
Competição será considerada final e não serão aceitas outras comunicações.
6.6
O Estado poderá notificar os Candidatos caso a Inscrição seja inválida ou rejeitada

porque não está de acordo com os Termos, mas não existe obrigação de assim o fazer.
Os Vencedores e Vice-campeões serão notificados por e-mail no prazo de três (3) dias
úteis a contar do anúncio dos Prêmios. Os nomes dos Vencedores e Vice-campeões
serão publicados no website do estado de Queensland
(www.studyqueensland.qld.edu.au) e na página da Competição no Facebook
(www.facebook.com/queenslandgapyear).
7
Consentimentos e garantias do candidato
7.1
Ao enviar a Inscrição, o Candidato garante ao Estado que é o único proprietário dos
direitos do Vídeo e Imagens e concede ao Estado uma licença permanente, sem
cobranças de royalties, global, não exclusiva, transferível e irrevogável (incluindo o
direito de sublicenciar) todos os Vídeos e Imagens enviados, bem como usar, explorar e
exercer todos os direitos de propriedade intelectual (incluindo reprodução e publicação)
para quaisquer fins relacionados a Competição ou competições semelhantes e sua
promoção futura. O Candidato consente em relação a qualquer lei que possa constituir

uma violação dos "direitos morais" sob a Copyright Act 1968 (Cth).
O Candidato concorda em fornecer ao Estado seu dados pessoais e uma cópia do Vídeo
ou Imagens para a empresa de relações públicas designada pelo Estado a fim de serem
utilizados nos propósitos descritos anteriormente. O Candidato aceita que a mídia pode

entrar em contato com o Candidato para discutir a Inscrição e o Candidato concorda em
trabalhar colaborativamente com a mídia conforme solicitação do Estado.
O Candidato reconhece e concorda que:

suas informações pessoais serão coletadas pelo Estado com a finalidade de
coordenar/administrar a Competição e para a notificação dos Candidatos com
relação a eventos futuros, iniciativas e programas administrados pelo Estado de
acordo com a política de privacidade disponível no link (inserir link) e através do
http://www.studyqueensland.qld.edu.au/privacy/;

Se o Candidato conquistar um prêmio, o Candidato concorda que o Estado
publicará seu nome relacionado a Competição nos materiais promocionais atuais
ou futuros.
ao enviar o Vídeo, o Candidato garante que todas as pessoas que possam ser
reconhecidas no Vídeo consentiram com a publicação de suas imagens pelo
Estado e seus agentes para uso na Competição e para uso em materiais
promocionais da Queensland Gap Year Competition atual ou futura e
(d)
o Candidato garante que o Vídeo é original, que não foi enviado para
participação em nenhuma outra competição e que não foi baseado no trabalho
de nenhuma outra pessoa.
8.
Obrigações dos Vencedores e Vice-campeões
8.1
Os Vencedores e Vice-campeões devem solicitar e receber um visto de estudo e/ou
trabalho (como estagiário) na Austrália da seguinte forma:

8.2

8.3
Os Vencedores e Vice-campeões devem ter bom caráter moral e

não podem estar sob influência de qualquer medicação, drogas ou outras
substâncias que possam prejudicar a capacidade de estudo, estágio e atividades
relacionadas;

(b)
obedecer esses Termos e Condições;
(c)
não publicar qualquer tipo de material que deprecie o Estado ou qualquer
patrocinador desta Competição e
(d)
frequentar todos os cursos e estágio.
Qualquer comportamento inadequado, ilegal ou que seja considerado pelo Estado como
imoral ou ilegal, bem como violações destes Termos e Condições por parte do Vencedor
ou Vice-campeão, pode resultar no cancelamento do Prêmio.
8.5
Os Vencedores e Vice-campeões devem assinar um Contrato de Voluntários com o

8.7
O Vencedor e os Vice-campeões devem fornecer documentações e preencher

formulários conforme solicitado pelos patrocinadores do Prêmio.
O Vencedor deve fazer postagens no blog uma vez por semana sobre sua experiência
em Queensland através das mídias sociais relevantes, sites e outros canais. O Vencedor
deve participar de eventos promocionais conforme convite do Estado no papel de
voluntário como embaixador dos estudantes internacionais de Queensland. O Vencedor
reconhece que o blog pode ser editado pelo Estado e, principalmente, que o blog não
deve apresentar nenhum conteúdo que seja:
(a)
ilegal, fraudulento ou considerado violação de propriedade intelectual ou outros
direitos, nem que seja difamatório e represente ou contenha comentários
depreciativos sobre pessoas ou empresas, bem como conteúdo de
informações pessoais de qualquer pessoa que não tenha dado autorização por
escrito para divulgação no blog;
(b)
obsceno, pornográfico, profano, sexualmente inadequado, violento, abusivo,
assediante, ameaçador, censurável ou depreciativo do ponto de vista de
qualquer etnia, raça, sexo, religião, grupo profissional ou faixa etária ou que
inclua nudez, profanidade ou obscenidade (conteúdo inadequado para
publicação);

(c)
promovedor de drogas ilegais, tabaco, armas de fogo ou seu uso, bem como
conteúdo que promova atividades que possam parecer inseguras ou perigosas;
(d)
(e)
promovedor do consumo irresponsável do álcool;
promovedor de qualquer pauta ou mensagem política ou
(f)
utilizador de marcas de produtos ou empresas além das autorizadas pelo
Estado.
e o Vencedor deve remover todo o conteúdo que viole tais condições imediatamente

assim que solicitado pelo Estado.
As postagens no blog podem estar em inglês ou no idioma nativo e podem incluir
relatórios, entradas de diário, blogs, fotos, postagens em mídias sociais, dentre
outros. As postagens devem englobar uma variedade de tópicos que refletem a visão
balanceada da experiência profissional, social e acadêmica do Vencedor na Austrália.
Cada comunicação feita deve ter pelo menos 50 palavras e incluir fotos ou vídeos das
experiências.
9.
Geral
9.1
A conformidade com os requisitos legais é responsabilidade do Vencedor e Vicecampeões. A viagem está sujeita às Condições Gerais de Transporte da companhia
9.2
aérea aplicável.
Se esta Competição estiver comprometida de alguma forma ou se não puder ser
realizada conforme razoavelmente previsto, por qualquer motivo que esteja além do
controle do Estado, o Estado reserva-se ao direito de modificar, suspender, encerrar ou

cancelar a Competição à seu próprio critério.
Até onde legalmente permitido, o Estado não será responsabilizado por qualquer lesão,
dano, despesa ou prejuízo (incluindo, dentre outros, os prejuízos indiretos ou
consequenciais) causados às pessoas ou propriedades decorrentes de qualquer ato ou
omissão, deliberada ou negligente, cometido pelo Estado, seus funcionários e agentes
com relação a participação na Competição ou organizações para fornecimento, ou o
próprio fornecimento, de prêmios aos vencedores da Competição.
9.4
O Estado reserva-se ao direito de fazer alterações nos Termos e Condições a qualquer
momento até a Data de Encerramento. Todas as alterações serão notificadas através da
página da Competição no Facebook.
9.5
Até onde legalmente permitido, nenhuma pessoa terá o direito de reivindicar
indenizações ou prejuízos do Estado com relação a qualquer questão que venha a surgir
em decorrência da Competição, incluindo, dentre outras, a não observância do Estado
dos Termos e Condições.
9.6
A decisão do Estado com relação a qualquer aspecto da Competição é final e vincula
todos os candidatos.
9.7
O Estado reserva-se ao direito de aceitar ou rejeitar qualquer Inscrição à critério

exclusivo.
Os Termos e Condições são regidos pelas leis de Queensland.
9.9
Esses Termos e Condições foram elaborados em inglês e as traduções em idiomas dos
países participantes foram preparadas apenas para referência. Em casos de
inconsistência, a versão em inglês deve ser aplicada e aceita por todas as partes.

TERMS AND CONDITIONS OF ENTRY
5.
Background
5.1.
“The Ultimate Gap Year – Queensland Australia” Competition (“Competition”) is
conducted by the State of Queensland through Trade and Investment Queensland ABN
93 887 376 875 (“the State”).
5.2.
Information on how to enter and the prizes form part of these Terms and Conditions of
5.3.
Entry (“Terms and Conditions”).
By submitting a completed “The Ultimate Gap Year – Queensland Australia” official entry
5.4.
form, “the Entrant” accepts the Terms and Conditions.
The Competition commences at 12:01am (AEST) on (TBC) 2014. Entries close at
11.59pm (AEST) on Saturday 31 May 2014 (“Closing Date”). Entrants will need to
determine the local start and close dates and times based on the time zone in their
location.
6.
The Prizes
6.1.
Entry into the competition gives Eligible Entrants the chance to win the following prizes:
(a)
One First Prize Package to one Entrant from Brazil (“Winner”).
6.2.
(b)
Two runner-up prizes to two Entrants from Brazil (the “Runners-Up”).

Schedule A:

7.
Conditions on the Prizes
7.1.
Conditions for the Winner
(a)
All land arrangements and flight bookings are subjected to availability. The State
reserves the right to revise the prize in the event of any unforeseen
circumstances.
(b)
The Winner must arrive in Queensland at latest by 30 September 2014 and
(c)
depart Australia at latest by 31 August 2015.
The Winner must meet Australian visa requirements.
(d)
The Prize excludes public liability insurance (except during the internship), cover
for dental and allied health expenses, excess baggage, meals, taxes, ancillary
costs, tours, ground transportation, airport transfers in home country, room
service or any other costs of a personal nature not stated in Schedule A.
(e)
Travel associated with the Prize is subject to availability at the time of booking.
(f)
The State will arrange all flight bookings. Any changes or costs incurred once the
tickets have been issued will be the sole responsibility of the Winner.
(g)
Airline tickets have no cash value, unused portions can not be redeemed for
cash value. No Frequent Flyer points are awarded on these tickets.
(h)
The State is not responsible for any change in the value of any Prize occurring
between the publishing date and date the prize is claimed.
(i)
Prizes are not transferable or exchangeable, and cannot be taken as cash.
(j)
The State does not make any representations about the quality or functionality of
any Prize, nor is it endorsing the Prizes or any party associated with the Prizes.
(k)
The internship component of the Prize must take place after the Winner has
completed all courses as part of the Prize and the Winner must:
(i)
(ii)
possess a valid visa to work in Australia;
ensure that the internship takes place in a field directly related to the
Winner’s educational background;
(iii)
possess intermediate – advanced English language skills (equivalent to
IELTS 5.0 or higher) to be able to participate in the internship; and
(iv)
provide a current resume or curriculum vitae including a colour photo, a
letter of internship objectives and a certified translation of their academic
transcript in English.
The pay during the internship will be in accordance with Queensland Labor Laws. The
Winner may be liable to pay Australian income tax on this amount.

Conditions for the Runners-up
(a)

Each Runner-Up must meet Australian visa requirements.
Each Runner-Up must attend to payment of all expenses including land

arrangements, accommodation and flights other than those stated in Schedule A.
Prizes are not transferrable or exchangeable and cannot be taken as cash.

The State does not make any representation about the quality or functionality of

any Prize nor is it endorsing the prizes or any party associated with the Prizes.
All courses must commence after 1 September 2014 and be completed before
31 August 2015 unless otherwise stated.
8.
Eligibility
8.1.
Entry to the Competition is open to persons aged between eighteen and thirty years old
as at 21 March 2014.
8.2.

Entrants must be a citizen and resident of Brazil (“participating Country”).
Australian nationals or permanent residents and international students who are either
presently or have previously studied in Australia in any form are excluded from
participation in the Competition.
4.4
Entrants must possess a current passport, be able to meet the legislative requirements of
an applicable visa to Australia and be available to visit Australia during the period from
September 2014 until August 2015 if chosen as a Winner or a Runner-up.
4.5
An Entrant must not have been convicted of any criminal offence and must not have had
a visa rejected or have been deported from Australia or any other country.
4.6
Entrants authorise the State to conduct civil, criminal, financial and other background or
reference checks considered necessary or desirable by the State.
4.7
Directors, management, employees and contractors of Trade and Investment
Queensland and those of any agencies and suppliers associated with the Competition
and the immediate family members of these people are ineligible to enter. “Immediate
family member” means spouse, parent, natural or adopted child and sibling (whether
natural or adopted by a parent), whether or not they live in the same household as the
director, manager, employee, officer or contractor.
5.
How to enter
5.1
To enter and be eligible to be a winner or runner-up in the Competition, Entrants must
before the Closing Date:

like the Competition Facebook page (www.facebook.com/queenslandgapyear);
(o)
complete “The Ultimate Gap Year – Queensland Australia” official form (“Entry”)
stating his/her full name as set out in his/her passport; and
(p)

provide a YouTube link to their Entry (“Video”) on how to promote and blog about
Queensland.
A valid Video entry must:
(a)
(b)
be in English;
not be longer than 60 seconds;
(c)
be received by the Closing Date. Any entry received after that date for any reason
including that the entry was lost, delayed or misdirected may not be accepted in
the absolute discretion of the State. No responsibility is accepted for late, lost,
delayed or misdirected Entries;

not contain any overt company or product branding (including URLs or telephone

numbers) even with permission of that organisation;
not be unlawful or fraudulent, or such that the State may deem (at its sole
(s)
discretion) in breach of any intellectual property, privacy, publicity or other rights;
not be defamatory, misrepresents or contains disparaging remarks about other
(t)
people or companies,
not contain any personal identification such as license plate numbers, personal
names, email addresses or street addresses;
(u)
not be obscene, pornographic, profane, sexually inappropriate, violent, abusive,
harassing, threatening, objectionable or derogatory of any ethnic, racial, gender,
(v)
religious, professional or age group;
not include nudity, profanity or obscenity, or be otherwise unsuitable for
(w)
publication;
not promote illegal drugs, tobacco, firearms/weapons or any activity that may
appear unsafe or dangerous or promotes any particular political agenda or
message; hunting or gambling , cruelty to animals or humans or the irresponsible
use of alcohol;

be able to be viewed without technical issues;
have 100 votes recorded. The Winning entry will not necessarily be the Video with
the most number of votes. An Entrant will attract votes for their Video by inviting
friends to vote for their Video and gaining bonus votes by looking at sponsors’
videos and liking sponsors’ Facebook pages; and
(z)
contain the Entrant’s contact details which must remain correct and kept up to
date through the competition Facebook page. If not, the State may award the Prize
to another Entrant.
6.
Judging
6.1
Short listed Entrants will be judged by the State’s nominated representatives for their
originality, creativity and ability to incorporate Queensland themes which will promote
Queensland and identify how a gap year in Queensland would benefit the Entrant’s
career.
6.2
6.3
Short listed Entrants will be asked to submit a resume with referees. The resume must
include educational background, work experience and other skills. At least 3 referees
must be provided including one academic, one employment and one personal.
The Judges’ decision on a shortlist of Entries (“Shortlist”) will be made and announced on
Monday 16 June 2014. The Shortlist will be made publicly available on the Competition
Facebook page (www.facebook.com/queenslandgapyear). The number of Entries in the
Shortlist is at the discretion of the State.

The Shortlisted Entrants will be contacted for an interview. Interviews will be conducted in
English only between 23 June and 4 July 2014 via web conferencing software.
6.5
The Winner and Runners-up for Brazil will be announced on July 7 2014. The State’s
decision on the Winners and the Runners-up of the Competition is final and no further
correspondence will be entered into.
6.6
The State may notify Entrants if their Entry is invalid or rejected because it does not
comply with these Terms, but it is under no obligation to do so.
6.7
The Winner and Runners-up will be notified by email within three (3) business days of the
Prizes being announced. The names of the Winner and Runners-up will be published on
the Study Queensland website (www.studyqueensland.qld.edu.au) and the Competition
Facebook page (www.facebook.com/queenslandgapyear).
7
Entrant’s consents and warranties
7.1
By submitting the Entry, the Entrant warrants to the State that the Entrant is the sole
owner of the copyright in the Photo or Video, and grants the State a royalty-free, worldwide, non-exclusive, transferrable, irrevocable, perpetual licence (including the right to
sub-licence) in respect of any Photo or Video submitted; to use, exploit and otherwise
exercise all intellectual property rights (including to reproduce and publish) for any
purpose connected with the Competition or similar competitions and their future
promotion. The Entrant consents to any act that might otherwise constitute an

infringement of their ‘moral rights’ under the Copyright Act 1968 (Cth).
The Entrant consents to the State providing personal details and a copy of the Photo or
Video to the State’s appointed public relations company for its use in the
abovementioned promotional purposes. The Entrant accepts that media may contact the
Entrant to discuss the Entry and the Entrant agrees to participate fully with the media as

requested by the State.
The Entrant acknowledges and agrees that:
(a)
their personal information will be collected by the State for the purpose of
coordinating/ administering the Competition and for notifying Entrants of
upcoming events, initiatives and programs administered by the State in
(b)
accordance with its Privacy Policy
if the Entrant wins a prize, the Entrant consents to the State publishing their
name in connection with the Competition in current or future promotional
materials.
(c)
by submitting the Video, the Entrant warrants that all recognisable persons in the
Video consent to the State or its agents publishing their images for use in the
Competition and for current or future Queensland Gap Year Competition
(d)
promotional purposes; and
the Entrant warrants that their Video is original, has not been submitted for any
other competition and is not based on the work of any other person.

8.
Obligations of Winners and Runners-up
8.1
The Winner and Runners-up must apply for and be granted a visa to study and/or to work
as an intern in Australia as follows:

8.4

illegal or in breach of these Terms and Conditions on the part of the Winner or a Runnerup may result in the cancellation of the Prize.

The Winner is expected to blog once a week on his/her experiences in Queensland
through relevant social media, websites and other channels. The Winner is expected to
attend promotional events as invited by the State in the voluntary role as Queensland’s
international student ambassador. The Winner acknowledges that the blog may be
edited by the State and in particular the blog must not contain any content that:
(a)
is unlawful or fraudulent or in breach of any intellectual property privacy or other
right or is defamatory and represents or contains disparaging remarks about
other people or companies or contains any personal identification for anyone
who has not given written authority for disclosure on the blog;
(b)
is obscene, pornographic, profane, sexually inappropriate, violent, abusive,
harassing, threatening, objectionable or derogatory of any ethnic, racial, gender,
religious, professional or age group or includes nudity, profanity or obscenity or
(c)
is otherwise unsuitable for publication;
promotes illegal drugs, tobacco, firearms or weapons or the use of any of these
(d)
or promotes any activity which may appear unsafe or dangerous;
promotes the irresponsible use of alcohol;
(e)
promotes any particular political agenda or message; or
(f)
contains any company or product branding other than as authorised by the
State
and the Winner must remove any content which breaches these conditions immediately
upon request from the State.
8.9
Blogging may be in English or his/her native language and may include reports, diaries,
blogs, photos, social media posts and others. The posts should concern a range of
topics that reflect a balanced view of the Winner’s academic, social and work experience
in Australia. Each communication should be at least 50 words and include photos or
videos of the experiences.
9.
General
9.1
Compliance with any lawful requirements is the responsibility of the Winner and the
Runners-up. Travel is subject to the General Conditions of Carriage of the applicable

If this Competition is compromised in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the State, the
State reserves the right in its sole discretion to modify, suspend, terminate or cancel the

Competition.
To the full extent permitted by law, the State is not liable for any injury, damages,
expenses or loss whatsoever (including but not limited to indirect or consequential loss)
to persons or property by reason of any act or omission, deliberate or negligent, by the
State, or its officers and agents in connection with participation in the Competition or the

arrangements for supply, or the supply, of any prizes to the winners of the Competition.
The State reserves the right to amend the Terms and Conditions at any time until the
Closing Date. Any amendments will be notified on the competition Facebook Page.

9.5
To the full extent permitted by law, no person is entitled to claim compensation or loss
from the State for any matter arising out of the Competition, including but not limited to a
failure by the State to comply with the Terms and Conditions.
9.6
The State’s decision in relation to any aspect of the Competition is final and binding on
every person who enters.
9.7
9.8
The State reserves the right to accept or reject any Entry at its sole discretion.
The Terms and Conditions are governed by the laws of Queensland.
9.9
These Terms and Conditions have been prepared in English and any translation into the
language of a Participating Country is prepared for reference only. In the event of any
inconsistency, the English language version shall apply and be binding on the parties.
