Resumo
O trabalho examina as antigas formas de expressão do direito de punir. Registra o
surgimento da prisão como pena. Relata a evolução das regras referentes à prisão
preventiva e liberdade provisória no Direito português e brasileiro. Apresenta uma síntese
de regras vigentes sobre prisão preventiva e liberdade provisória em alguns ordenamentos
jurídicos estrangeiros, assim como das normas internacionais. Exibe, ainda, os efeitos das
normas internacionais no Direito brasileiro.
This study inquires into the ancient forms of punishment rights. It also demonstrates the
appearing of imprisonment as a penalty. This paper studies the evolution of the rules
referring to provisional arrest and interim release in the Portuguese and Brazilian Law. It
sows a synthesis of nowadays foreign Law and the International Law referring to
provisional arrest and interim release. As wall, it examines the effects of these International
rules in the Brazilian Law.
