Anexo D.3 – Declaração de compromisso
Para os fins previsto neste formulário, o candidato a promotor do projeto declara que:
a) São verdadeiras todas as informações do presente formulário e respetivos anexos;
b) Assegura o cumprimento da programação temporal, física e financeira do projeto em apreço;
c) Se necessário, assegura a disponibilidade orçamental em níveis adequados à execução do projeto, de
acordo com a programação apresentada;
d) Possui ou tem capacidade para assegurar os meios técnicos, físicos e os recursos humanos necessários ao
desenvolvimento do projeto;
e) Dispõe, ou irá dispor, o mais tardar à data da celebração do contrato de projeto, de sistema de
contabilidade organizada, de acordo com o plano de contabilidade aplicável, e mantém um sistema
contabilístico separado ou um código contabilístico adequado para todas as transações relacionadas com
o projeto;
f) Assegura o cumprimento de todas as disposições regulamentares e contratuais associadas ao
financiamento, tal como definido no Regulamento Geral de Acesso a Financiamento de Projetos de
Adaptação às Alterações Climáticas e nos Anúncios de Candidatura, bem como no Regulamento MFEEE
2009-2014 (Regulation on the implementation of the European Economic Area Financial Mechanism 2009
– 2014 - RIMFEEE);
g) Não ter sido responsável pela apresentação da mesma candidatura a outra fonte de financiamento, no
âmbito da qual ainda esteja a decorrer o processo de decisão ou em que a decisão sobre o pedido de
financiamento tenha sido favorável;
h) Nenhuma das componentes do investimento previsto no projeto foi objeto de financiamento ou
cofinanciamento comunitário ou irá ser incluída noutro projeto ou operação a candidatar a qualquer
outro Programa de apoio comunitário;
i) Não foi responsável por falsas informações ou viciação de dados, com o objetivo de obter benefício
indevido, ocorridas na apresentação, na apreciação ou na execução dos investimentos em projetos da
sua responsabilidade que foram objeto de financiamento ou cofinanciamento externo, no período de
cinco anos antes da apresentação desta candidatura;
j) Assegura o cumprimento das obrigações inerentes ao promotor do projeto, definidas no Artigo 7º do
Regulamento Geral de Acesso a Financiamento de Projetos de Adaptação às Alterações Climáticas e nos
Anúncios de Candidatura;
k) Assegura a conformidade com os procedimentos legais nacionais e comunitários aplicáveis, incluindo,
mas não limitado a, legislação ambiental, legislação de contratação pública e legislação sobre ajudas de
estado;
l) Assegura o cumprimento dos princípios orientadores regulamentares, designadamente a transparência,
responsabilidade e custo eficiência, a boa governança e o desenvolvimento sustentável, e a igualdade de
género e de oportunidades;
m) Assegura o cumprimento das obrigações de comunicação e imagem, respeitando o Anexo 4 do RIMFEEE.

Annex D.3 – Commitment statement
For the purposes contemplated in this form, the promoter of the candidate project states that:
a) All the information on this form and its annexes is true;
b) Assures the compliance of the temporal, physical and financial programming of the project;
c) If necessary, assures the budget availability at appropriate levels for the implementation of the project
according to the planning presented;
d) Has the means to assure the technical, physical and human resources needed to develop the project;
e) Has, or will have, not later than the date of the celebration of the project contract, a proper accounting
system in accordance with the accounting plan applicable, maintaining a separate accounting system or
an adequate accounting code for all transactions related to the project;
f) Assures the compliance of all statutory and contractual arrangements associated with the financing, as
defined in the General Regulation of Access to the Financing of Projects of Adaptation to Climate Change
and Call for Application, and Regulation on the implementation of the European Economic Area Financial
Mechanism 2009 - 2014 (RIEEAFM);
g) Hasn’t been responsible for submitting the same application to another funding source, within which the
process of decision is still in place, or that already was selected for funding;
h) None of the components of the planned investment in the project was object of funding or co -funding by
the EU or will be included in another project or operation to be applied to any other European fund;
i) During the previous five years from the submission of this application, wasn’t responsible for false
informations or tampering of data, in order to obtain undue benefits, occurred in the presentation, in the
evaluation or in the execution of funds in projects of its responsibility that were subject to exter nal
financing or co-financing;
j) Assures the compliance with the obligations inherent to the promoter of the project, as defined in Article
7 of the General Regulation of Access to the Financing of Projects of Adaptation to Climate Change and
Call for Application;
k) Assures compliance with EU and national legal procedures applicable, including, but not limited to,
environmental legislation, public procurement legislation and legislation on State aids ;
l) Assures compliance with the regulations guiding principles, including transparency, responsibility and
cost efficiency, good governance and sustainable development, and gender equality and equal
opportunities;
m) Assures compliance of the obligations on information and publicity requirements, according to Annex 4 of
RIEEAFM.
