Agreement on the supply of plant material by the Jardim Botânico Tropical
The Jardim Botânico Tropical (JBT) intends to honor the letter and spirit of the 1992 Convention on
Biological Diversity of 1992 (CBD) in the use of its collections. The garden therefore expects its partners
in acquiring, maintaining and transferring plant material to always act in accordance with the CBD and
the Convention on the International Trade in Endangered Species (CITES).
The responsibility for legal handling of the plant material passes upon the recipient upon receipt of the
material. The requested plant material will be supplied to the recipient on the following conditions:
1. The material is intended to serve the common good, particularly the areas of research, education, and
the interests of environmental protection.
2. Upon accepting plant material from our garden, the recipient is obliged to document and preserve
information related to the material appropriately.
3. Scientific publications resulting from the use of the material should mention the JBT as supplier. These
publications are supposed to be sent automatically, to the JBT, without request.
4. Intended commercial use by the recipient is not covered by this agreement. The commercialization is
the object of a separated agreement with the country of origin. The country of origin prior informed
consent (PIC) must be obtained in writing before the material is used or transferred. The recipient is
responsible for ensuring an equitable sharing of benefits. The user is obliged to share benefits with the
country of origin and to forward relevant information to the CBD authority.
5. The recipient garden will forward information on the material supplied on request to the CBD
authority.
6. Plant material may only be supplied on the basis and under the conditions of this or corresponding
agreements.
