Does the scheme have the support of the responsible public
authorities in your country? If so, please give details.
A grande mudança de paradigma partiu da iniciativa dos juízes e funcionários
(em especial do secretário do Tribunal). Porém, tais iniciativas não seriam tão
ousadas caso faltasse o apoio – formal e informal - das instituições
responsáveis pelo funcionamento do Tribunal.
Nesse sentido, e muito relevante, foi o teor do Decreto-Lei n. 177/2006 de
31.08.2008, lei que extinguiu vários juízos e atribuiu os seus processos a
outros Juízos (entre eles o 11º Juízo). O preâmbulo deste diploma legal,
aprovado em Conselho de Ministros, refere expressamente os bons
resultados de dois Juízos e a importância de atribuir a esses juízos os
processos dos piores juízes (cujo encerramento foi determinado).
O Conselho Superior da Magistratura, a Direcção Geral da Administração da
Justiça e a Procuradoria Geral da República têm apoiado, dentro das suas
valências, o Tribunal, fornecendo todas as condições materiais necessárias
(que são excelentes), bem como disponibilizando os melhores quadros.

Do you believe the scheme to be usable in other courts in European
states? Give your reasons.
A experiência de um Tribunal liquidatário pode ser perigosa se se decide,
sem mais, encerrar o Tribunal, dizendo “não entram mais processos”, sem se
assegurar um conjunto de mecanismos que impeçam que os quadros que
ficam a gerir esse Tribunal entupido se acomodem e pensem que aquele
Tribunal, no estado em que está, irá durar tranquilamente até à sua reforma
aos 65 ou mais anos. Por essa razão, penso que a nossa experiência poderá
ser muito útil para Tribunais com as mesmas características.
Relativamente a Tribunais comuns, a experiência de gráficos mensais – no
nosso Juízo resultaram da exclusiva iniciativa do secretário do Tribunal – é um
precioso auxiliar para todos quantos trabalham nos tribunais, pois permite
não só aferir da evolução de cada juízo, como detectar desvios ou práticas
que levem a atrasos significativos na evolução do juízo, além de ser um
poderoso instrumento de análise para uma gestão pró-activa do Tribunal.
