Em 26.abr.2010, a Organização Mundial da Propriedade Intelectual (OMPI)
celebra o 10º aniversário do Dia Mundial da Propriedade Intelectual e o 40º
aniversário do início da vigência da Convenção que estabeleceu a OMPI.
On 26.Apr.2010, the World Intellectual Property Organization (WIPO) is
celebrating the World Intellectual Property Day 10th anniversary and the 40th
anniversary of entry into force of the Convention establishing the WIPO.
Nessa mesma data, a ABREU, MERKL tem o prazer de comemorar o 5º
aniversário de seu Infomail, o qual chega a 30ª edição!

Relevance and ABNT Courses
Adotar normas de Segurança da Informação assegura às empresas a
proteção do ativo mais importante dos seus negócios: a informação. A
preservação da confidencialidade, da integralidade e da disponibilidade das
informações, por sua vez, é imprescindível à proteção dos direitos de
propriedade intelectual (PI), de modo que a implantação do Sistema de
Gestão de Segurança de Informação (SGSI) é uma grande aliada da PI.
Adopting Information Security standards guarantees the companies
protection to their businesses' most important asset: the information. The
preservation of the confidentiality, integrity and availability of the information
is, in its turn, indispensable for the protection of intellectual property (IP) rights,
such that the implementation of the Information Security Management System
(ISMS) is a great ally for the IP.
Atenta à inter-relação desses importantes mecanismos de gestão das
atividades empresariais, a ABREU, MERKL, em conjunto com a Associação
Brasileira da Propriedade Intelectual (ABPI), apoiou a iniciativa inédita no
estado do Paraná da Associação Brasileira de Normas Técnicas (ABNT),
órgão responsável pela normalização técnica no país, na realização de dois
importantes cursos ministrados pelo eminente Sr. Ariosto Farias Junior, nos
dias 29 a 31.mar.2010, na sede da ABREU, MERKL:
Attentive to the relationship of these important business activities
management mechanisms, ABREU, MERKL, together with the Brazilian
Association of Intellectual Property (ABPI), supported a pioneer initiative in
the Paraná State of the Brazilian Technical Standards Association (ABNT),
entity in charge with the country's technical standardization, in the realization
of two important courses taught by the eminent Mr. Ariosto Farias Junior, on
29-31.Mar.2010, at ABREU, MERKL premises:
- Curso sobre as normas ABNT NBR ISO IEC 27001:2006 e ABNT NBR ISO
IEC 27002:2005, que tratam do SGSI, dos Requisitos e do Código de Prática
para a Gestão da Segurança da Informação;
- Course on ABNT NBR ISO IEC 27001:2006 and ABNT NBR ISO IEC
27002:2005 standards, which deal with the ISMS, with the Requirements and
the Code of Practice for the Information Security Management, respectively;
- Curso para Formação de Auditores Internos do SGSI, baseado na ABNT
NBR ISO IEC 27001:2006.
- Course for Professional Training of ISMS Internal Auditors, based on ABNT
NBR ISO IEC 27001:2006.
Além de reforçar a importância do tema regionalmente, tal parceria também
oportunizou desenvolvimento e formação à equipe da ABREU, MERKL. O
primeiro curso contou com a participação de Luis Henrique Faria Jorge e de
Telmino Oliveira, assistente jurídico e trainee em TI, respectivamente. Com o
segundo curso, as advogadas Izabel Guimarães Michelato e Ana Paula
Lopes obtiveram qualificação como Auditoras Internas do SGSI.
Besides reinforcing the themes' relevance at a regional level, this partnership
also enabled development and professional training to ABREU, MERKL team.
The first course was attended by Luis Henrique Faria Jorge and Telmino
Oliveira, legal assistant and IT trainee, respectively. Through the second
course, the Attorneys-at-Law Izabel Guimarães Michelato and Ana Paula
Lopes obtained qualification as ISMS Internal Auditors.

Mais um marco para a matéria ocorreu também nesse mês de março com a
instalação pela ABNT, em 25.mar.2010, da Comissão de Controle e Combate
a Fraudes - CEE 139 - espelho no Brasil do Comitê ISO TC 247 - “Fraud
Countermeasures and Controls”.
Another landmark for the subject also took place this March with ABNT
establishing, on 25.Mar.2010, the “Comissão de Controle e Combate a
Fraudes” - CEE 139 - which mirrors, in Brazil, the ISO Committee TC 247 Fraud Countermeasures and Controls.
A advogada Izabel Guimarães Michelato, da ABREU, MERKL, esteve
presente na reunião de instalação da Comissão representando a ABPI tendo
em vista que o Comitê Internacional ISO 247 manterá contato com a
Organização Mundial da Propriedade Intelectual (OMPI), uma vez que
assuntos concernentes à PI também serão abordados em ambos os Comitês.
Essa foi a primeira reunião de uma série de quatro que deverão ocorrer por
ano.
ABREU, MERKL Attorney-at-Law, Izabel Guimarães Michelato, was present
at the meeting establishing the Commission representing ABPI due to the fact
that the ISO 247 International Committee will be maintaining contact with the
World Intellectual Property Organization (WIPO), since IP related matters will
also be dealt with in both Committees. This has been the first of a series of four
meetings to be held annually.

Neste ano de 2010, a Fédération Internationale de Football Association (FIFA)
está promovendo a 19ª edição da Copa do Mundo de futebol, que ocorrerá na
África do Sul.
In this year of 2010, the Fédération Internationale de Football Association
(FIFA) is promoting the 19th edition of the soccer World Cup, which will take
place in South Africa.
Grandes eventos esportivos tais como a Copa do Mundo e os Jogos
Olímpicos organizados pelo International Olympic Committee (IOC) exigem
altos investimentos, os quais são provenientes de várias fontes.
Major sports events such as the World Cup and the Olympic Games organized
by the International Olympic Committee (IOC) require heavy investments,
which come from various sources.
No caso da Copa do Mundo, uma parte substancial desses investimentos se
origina de entidades para as quais a FIFA concede certos direitos
relacionados à Copa do Mundo em diferentes níveis. Os Parceiros da FIFA
possuem o maior pacote de direitos de propaganda, promoções e marketing.
Os Patrocinadores da Copa do Mundo da FIFA possuem o segundo maior
pacote desses direitos. Os Apoiadores Nacionais possuem um pacote de
direitos no território da África do Sul. Os Licenciados possuem o direito de uso
das Marcas Oficiais licenciadas em itens de merchandising e os Parceiros de
Exibição possuem direitos de exibição ou transmissão dos sinais de um jogo
da Copa do Mundo.
As regards the World Cup, a substantial part of these investments originates
from entities to which FIFA grants certain World Cup-related rights at different
levels. FIFA Partners have the broadest package of advertising, promotional
and marketing rights. FIFA World Cup Sponsors have the second broadest
package of such rights. The National Supporters have a package of said rights
in the territory of South Africa. The Licensees have the right to use the licensed
Official Marks in items of merchandise and the Broadcast Partners have rights
to broadcast or transmit feeds of a match of the World Cup.
Além de todos os investimentos feitos pelas entidades ligadas oficialmente
aos organizadores da Copa do Mundo, o sucesso do evento também está
relacionado com toda a euforia do público e o envolvimento de outras
empresas que indiretamente promovem os jogos por meio das diversas
oportunidades por eles proporcionadas.
Beside all the investments made by the entities that are officially linked to the
World Cup organizers, the success of the event is also related with all the
euphoria of the public and the involvement by other businesses that indirectly
promote the games through the many opportunities provided thereby.
Não obstante, em alguns casos “pegar uma carona” no evento pode ser
considerado ilegal. Por exemplo, uma associação não autorizada pode
ocorrer quando uma empresa, sem a respectiva licença, afixa em seus
produtos as marcas oficiais da Copa do Mundo ou usa ditas marcas em peças
publicitárias. Da mesma maneira, muitos restaurantes, bares e outros
estabelecimentos preparam estes locais para a transmissão dos jogos ao
público, em alguns casos cobrando uma taxa de entrada.
Nevertheless, in some cases “free riding” in the event may be considered
illegal. For instance, an unauthorized association may occur when a company,
without the respective license, affixes the official trademarks of the World Cup
in its products or uses said trademarks in pieces of advertisement. In the same
sense, many restaurants, bars and other establishments set up these venues
for broadcasting the matches, in some cases charging an entrance fee.
Assim, é necessário estar atento às regras da FIFA, que variam conforme os
tipos de eventos, classificados em “comerciais” e “não- comerciais”. Um dos
principais critérios adotados pela FIFA para determinar o tipo de evento é o
propósito do exibidor, sendo considerado comercial quando, por exemplo, é
cobrada uma taxa direta ou indireta de entrada para a exibição dos jogos, ou
quando se explora um patrocínio para o evento. Por outro lado, a mera
apresentação da partida em um local aberto ao público, tal como um bar ou
um restaurante, não é considerada como comercial, desde que dita exibição
não esteja associada a outros propósitos comerciais, tais como atividades
promocionais, loterias, venda de ingressos etc.
Hence, attention should be paid to FIFA rules, which vary according to the
types of events, classified as “commercial” and “non-commercial”. One of the
main criteria adopted by FIFA for determining the type of event is the purpose
of the exhibitor, for instance, it is commercial if the exhibitor charges a direct or
indirect admission fee for the showing of games or explores a sponsorship for
the event. On the other hand, the mere exhibition of the match in a venue open
to the public, such as a bar or a restaurant, would not be considered
commercial as long as said exhibition is not associated with other commercial
purposes, such as promotional activities, lottery draws, tickets sales etc.
Para a edição deste ano, a FIFA disponibilizou um sistema online para a
concessão de licenças para a exibição ao público; contudo, esse sistema não
é aplicável em alguns poucos países tais como o Brasil, no qual a requisição
de licença deve ser submetida ao Parceiro de Exibição local da FIFA (TV
Globo).
For this year's edition, FIFA provided an online system for granting public
viewing licenses; however, this system is not applicable in a few countries
such as Brazil, in which the request for a license needs to be submitted to the
local Broadcasting Partner (TV Globo).
De acordo com as regras gerais da FIFA, tanto os eventos comerciais como
os não-comerciais exigem obtenção de uma licença formal. Entretanto, no
caso do Brasil, a TV Globo e a FIFA comunicaram conjuntamente que os
eventos não-comerciais estão dispensados da obtenção da licença formal.
Conforme o comunicado à imprensa, essa dispensa todavia não desobriga
aqueles que forem exibir os jogos de seguir estritamente as outras regras, tais
como incluir os 10 minutos ante e pós jogo, sem quaisquer alterações,
adições ou deleções.
According to FIFA's general rules, both commercial and non-commercial
events require execution of a formal license. Nevertheless, in Brazil's case, TV
Globo and FIFA jointly-announced that those non-commercial events are
exempted from obtaining the formal license. According to the press release,
this exemption though does not release those who will exhibit the matches
from strictly following the other rules, such as including 10 minutes pre and
post game, without any alterations, additions or deletions.
Desta forma, desde que tomadas as devidas precauções, é possível
beneficiar-se da euforia popular causada pela Copa do Mundo sem que
sejam violados os direitos de propriedade intelectual da FIFA e daqueles que
contribuíram financeiramente para viabilizar a realização deste grande
evento.
Therefore, provided that all due care is taken, it is possible to benefit from the
popular euphoria caused by the World Cup without infringing the intellectual
property rights of FIFA and of those who financially contributed to the viability
of this great event.

êxito o Programa de Educação Executiva “Intellectual Property and Business
Strategy” da Harvard Business School (HBS), no mês de fevereiro de 2010,
em Boston (EUA).
The Attorney-at-Law and Industrial Property Agent, Marcio Merkl,
successfully completed the Harvard Business School (HBS) Executive
Education Program “Intellectual Property and Business Strategy”, in February
2010, in Boston (US).
Por meio do estudo de casos oriundos de vários países, painéis e aulas
interativas, o programa da HBS explorou as questões que as empresas
devem levar em conta a fim de aumentar o valor decorrente da propriedade
intelectual.
Through case studies drawn from several countries, panel discussions and
interactive lectures, the HBS program explored the issues companies must
consider to increase the value derived from intellectual property.

A Agência Paranaense de Propriedade Industrial (APPI), um dos braços do
Instituto de Tecnologia do Paraná (TECPAR), realizou em parceria com o
Instituto Nacional de Propriedade Industrial (INPI/BR), o Curso por Módulos
em Nível Básico de Propriedade Intelectual para Gestores de Tecnologia, que
teve como objetivo apresentar uma visão atualizada dos mecanismos de
proteção das criações intelectuais e a importância desta proteção para a
inovação e o desenvolvimento tecnológico.
The Paraná Agency of Industrial Property (APPI), an arm of the Paraná
Institute of Technology (TECPAR), held in association with the Brazilian
National Institute of Industrial Property (INPI/BR) the Course in Modules on
Basic Level of Intellectual Property for Technology Managers, which aimed to
present an updated view of the intellectual creations protection mechanisms
and the importance of this protection for innovation and technological
development.
O evento ocorreu entre os dias 01-03.mar.2010, em Curitiba, Paraná, e

A Seccional Sul da Associação Brasileira dos Agentes da Propriedade
Industrial (ABAPISUL) promoveu, entre os dias 19-21.mar.2010, em
Florianópolis, Santa Catarina, seu V Encontro Regional. Este ano, o evento
trouxe painéis do interesse de todos os atuantes da área, abordando desde a
“Avaliação de Intangíveis e Apuração de Quantum Indenizatório”, “Emendas
em Processos de Patentes”, “Desenhos Industriais: Procedimentos para
Obtenção ao Reconhecimento pelo Judiciário”, até a análise das alternativas
de proteção de marca no exterior.
The Brazilian Association of Industrial Property Agents South Regional
(ABAPISUL) held, between 19-21.Mar.2010, in Florianopolis, Santa Catarina
state, its 5th Regional Meeting. This year, the event featured panels of interest
to all those working in the field, ranging from the “Evaluation of Intangible
Assets and Quantum of Damages Assessment”, “Amendments in Patenting
Processes”, “Industrial Designs: Procedures for Obtaining Recognition from
the Judiciary”, to the analysis of alternatives for trademark protection abroad.
